{"id":12114,"date":"2024-01-24T05:32:20","date_gmt":"2024-01-24T10:32:20","guid":{"rendered":"https:\/\/www.routineproceedings.com\/?p=12114"},"modified":"2024-01-24T02:10:24","modified_gmt":"2024-01-24T07:10:24","slug":"roundup-federal-court-says-emergencies-act-didnt-meet-the-threshold","status":"publish","type":"post","link":"https:\/\/www.routineproceedings.com\/2024\/01\/24\/roundup-federal-court-says-emergencies-act-didnt-meet-the-threshold\/","title":{"rendered":"Roundup: Federal Court says Emergencies Act didn&#8217;t meet the threshold"},"content":{"rendered":"<p>The Federal Court <a href=\"https:\/\/www.cbc.ca\/news\/politics\/emergencies-act-federal-court-1.7091891\">ruled<\/a> yesterday that the invocation of a public order emergency under the <em>Emergencies Act<\/em> didn\u2019t actually meet the threshold for such a declaration. (Full decision <a href=\"https:\/\/www.fct-cf.gc.ca\/Content\/assets\/pdf\/base\/2024.01.23-306-22-T-316-22-T-347-22-T-382-22.pdf\">here<\/a>). As a result, some of the uses of emergency powers were overbroad, such as the curtailment of freedom of expression in clearing the occupation, or that the police just kind of made it up as they went along as they froze the bank accounts of the owners of trucks participating in the occupation (and really, only about 57 individuals were affected). The federal government declared immediately that they were going to appeal this decision, citing in part the fact that the public inquiry didn\u2019t come to the same conclusion. While I have a full story coming out later today on this, it\u2019s important to note that the ruling was fairly narrow and technical, rejected a number of the complainants that were part of it, and largely affects future invocations of the Act, having little effect on what happened (because we can\u2019t <a href=\"https:\/\/youtu.be\/9n3A_-HRFfc?si=Hm3BBVML6sJzXxaX\" target=\"_blank\" rel=\"noopener\">turn back time<\/a>).<\/p>\n<p>Amidst the <a href=\"https:\/\/www.thecanadianpressnews.ca\/politics\/heres-how-key-players-reacted-to-the-federal-courts-decision-on-the-emergencies-act\/article_a443487e-f59f-5c7a-819d-df23357adb7e.html\">various reactions<\/a>, revisionism certainly was on display among the talking heads over the course of the evening, who insisted that the government had more \u201csurgical\u201d tools they could have used instead of invoking the Act, erm, except no, they didn\u2019t. The problem was that Doug Ford washed his hands of the whole thing, and eventually the federal government had no other option than to invoke the Act because nobody else was getting control of the situation. And the Conservatives? They are eating up this decision and spreading shitposts far and wide over their socials about how this was a condemnation of Trudeau, and how \u201cdivisive\u201d he was, and so on. This feeds directly into their dystopian world-building where they are pretending that Trudeau is some kind of jackbooted dictator taking away people\u2019s rights, when that\u2019s explicitly not what happened here, or any reflection of our objective reality whatsoever. But they want to create the illusion that this is true for their believers, because when you can get them to stop believing in our objective reality, people are so much easier to manipulate.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">I have to say, the speed by which he came out with one of his shitpost videos on the ruling is pretty remarkable. <a href=\"https:\/\/t.co\/nqFKe697A4\">pic.twitter.com\/nqFKe697A4<\/a><\/p>\n<p>&mdash; Dale Smith (@journo_dale) <a href=\"https:\/\/twitter.com\/journo_dale\/status\/1749931131619647628?ref_src=twsrc%5Etfw\">January 23, 2024<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>In commentary, Emmett Macfarlane makes a <a href=\"https:\/\/emmettmacfarlane.substack.com\/p\/a-dubious-judgment-on-the-emergencies\">reasoned case<\/a> for disagreement with the decision which is well worth reading, while Paul Wells <a href=\"https:\/\/paulwells.substack.com\/p\/not-justified-and-unreasonable\">makes<\/a> more of a case for this decision over the public inquiry, though I suspect he too falls a little into the trap of revisionism because the existing tools weren\u2019t working precisely because Doug Ford refused to act.<\/p>\n<p>Ukraine Dispatch:<\/p>\n<p>Russian <a href=\"https:\/\/www.reuters.com\/world\/europe\/russia-launches-missile-strike-kyiv-says-ukraines-military-2024-01-23\/\">missile strikes<\/a> on Kyiv and Kharkiv have killed 18 people, which Russia <a href=\"https:\/\/www.reuters.com\/world\/europe\/russia-strikes-ukrainian-military-industrial-complex-facilities-defence-ministry-2024-01-23\/\">claims<\/a> are all hits on the military-industrial complex. It is more likely that Russia is <a href=\"https:\/\/www.reuters.com\/world\/russia-probing-ukraine-weaknesses-us-funding-stalls-2024-01-23\/\">probing<\/a> Ukraine\u2019s defences for weakness as they suffer from shortages because Western arms manufacturers are slow to produce new ammunition and equipment, and the US\u2019 budget deadlock is not helping matters any. On the front lines, the reliability of drones used by Ukrainian troops is of <a href=\"https:\/\/www.reuters.com\/world\/europe\/drones-are-hit-miss-ukrainian-soldiers-2024-01-23\/\">varying quality<\/a> because many of them are cheaply and hastily assembled.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The rescue operation continues in the aftermath of another Russian attack on our cities and people.
