Roundup: C-10 shenanigans have poisoned the well of our parliament

Because things around Bill C-10 couldn’t get any more ridiculous, we now have news stories about Michael Geist getting the vapours about how amendments are being rushed through committee in a “secretive” manner, as though he’s never witnessed a clause-by-clause debate before. And to an extent, what has happened with that committee is the result of a complete breakdown of how it should be operating, forcing the government to impose time allocation on the process – a rare manoeuvre at the committee stage – because it has become so toxic. And with the whips intervening, this turned into essentially a forced meeting that the chair himself objected to, but again, this whole process has become so toxic because of partisan gamesmanship.

First things first ­– Geist’s vapours are more or less melodramatic, because there are still several other opportunities to see what amendments have been agreed to – the final committee report, which goes to Report Stage debate in the Chamber, where the full Commons can vote to accept or reject those amendments. And then there is third reading. If anything, particularly egregious is in there, it can still be caught and amended, and while rare at those stages, it is possible. And then there is the entire Senate process, where they can hear from yet more witnesses in their own committees on the amended version of the bill, and given that this particular iteration of the Senate is far more activist and interventionist, we can bet that there will be more impetus for amendments there (which could force an awkward contest of wills around those amendments given that they’d have to go back to a Commons that has risen for the summer, and at a time when nobody in this city can shut up about election speculation). Nevertheless, the point stands that there are several avenues yet for more amendments to this bill than what happened at the Commons committee.

The bigger point here, however, is that the reason this process became so toxic was because the Conservatives took a fundamentally – nay, existentially – flawed bill, and decided that instead of engaging its actual flaws, they would invent a whole litany of straw men and red herrings, and try to get the country up in arms over fictional provisions that they pulled out of their asses and held them up as effigies to be burned in protest. It’s a bad bill – it never should have placed under the Broadcasting Act because that statute deals with the assumption of the limited bandwidth of TV and radio, and trying to apply it to the internet is largely unworkable. This is a legitimate criticism that should have been debated, but instead, we got this fabrication of an Internet Czar who is going to be vetting your tweets and Facebook posts, and dark visions of Orwellian censorship at the hands of the CRTC, which is not even remotely plausible. But they went full-tilt with this insanity, and just completely poisoned the well of parliament along the way.

The government is not blameless here either – the minister’s communication around the bill has been nothing short of a disaster in English Canada, and his stumbles have been extremely damaging, but he’s been given a long leash because this is playing well in Quebec (where discoverability is a huge vote-getter because they do have difficulty finding Quebec and Canadian content in French – pointing to how the debate on this bill has been hugely built on what I’m going to dub “Anglophone privilege.”) We could have had a constructive debate around this bill. But we didn’t. A mountain of lies was countered by communications incompetence, and after six weeks of absolute shenanigans at committee, the government had enough and brought the hammer down. None of this needed to happen, but apparently we don’t have enough grown-ups in our parliament, and that’s just a sad, sad state of affairs.

Roundup: Atwin crosses to the Liberals

There was a somewhat shocking turn of events yesterday as Green MP Jenica Atwin suddenly crossed the floor to the Liberals, after weeks of turmoil within the party over the policies around Israel. When Atwin made comments about Israel being an apartheid state, one of leader Annamie Paul’s advisors threatened her position, and she decided it was time to go. Remember also that the NDP have a Thing about floor-crossing, and wouldn’t have accepted her, leaving her with just the Liberals as a potential home rather than staying an Independent – no doubt increasing her chances at re-election. She insisted that all of her previous comments and votes stood, no matter that she was now a Liberal, so perhaps she will remain among the more “maverick” MPs in the caucus who don’t all toe the line in the same way.

Of course, with any floor-crossing, we get the same tired chorus of voices demanding that anyone who does cross must immediately resign and run in a by-election, which is nonsense in the broader context of how our system works. We elect MPs – we don’t elect parties, even if that’s your calculation when you go into the voting booth. Why this distinction matters is because we empower MPs to act on our behalf, regardless of the party banner, and then we get to judge them for their performance in the next general election. Sometimes MPs will need to make decisions to cross the floor for a variety of reasons, but usually because it’s intolerable in their current situation, and they make the move. We empower them to do so because our electoral system gives them agency as an individual – they’re not a name off of a list because the party got x-percentage of a vote.

This absolutely matters, and we need to enshrine their ability to exercise their ultimate autonomy if we want our system to have any meaning. Otherwise we might as well just fill the seats with battle droids who cast their votes according to the leader’s wishes, and read pre-written speeches into the record that the leaders’ office provided. The trained seal effect is bad enough – we don’t need to erode any last vestiges of autonomy to please the self-righteous impulses of a few pundits who think that this kind of move is heretical or a betrayal, or worse, to appeal to the desire by certain parties (in particular the NDP) to have their power structure so centralized that they see their MPs as a mere extension of their brand rather than as individuals. Parliament means something – the ability of MPs to make ultimate decisions needs to be respected in that context.

QP: Security breach and securities regulators

While the prime minister was off to the G7 meeting in the UK, the only Liberal in the Chamber was Francis Drouin, though Mark Gerretsen would replace him later in the hour. Erin O’Toole led off, accusing the government of hiding a security breach at the National Microbiology Lab. Jennifer O’Connell warned that O’Toole was playing a dangerous game, and that redacted documents were provided to the Canada-China committee and the unredacted documents went to NSICOP. O’Toole accused her of participating in a cover-up, and O’Connell accused O’Toole of not caring about national security. O’Toole scoffed, noting his military service, and worried there was a Chinese “infiltration” at the Lab, which O’Connell countered with a prof at the Royal Military College praising NSICOP. O’Toole then repeated his first question in French, got the same answer as before, adding that she used to be a member of NSICOP so she could vouch for its security. O’Toole repeated his allegation of a cover-up in French, and O’Connell, exasperated, noted that she wasn’t sure how many more times she could say that they turned over the documents in the appropriate way.

Alain Therrien led for the Bloc, accusing the government of trying to create a new pan-Canadian securities regulator which Quebec opposed. Sean Fraser noted that the office cooperated voluntarily with provinces. Therrien tried again, and Fraser repeated that Quebec was not bound to work with that office.

Alexandre Boulerice rose for the NDP, and he condescended to the government about the WE Imbroglio, and demanded that the government respect the Ethics committee’s report. Bardish Chagger thanked the committee for the work, but accused them of being more interested in partisan games. Charlie Angus then repeated the demand in English with added sanctimony and stretched the credulity of the allegations, and Pablo Rodriguez batted away the insinuations.

Roundup: Trudeau cleared, Morneau not

The Conflict of Interest and Ethics Commissioner released his reports on Justin Trudeau and Bill Morneau’s involvement in the WE Imbroglio yesterday, and came to two different results – the prime minister was cleared, but Morneau was found to have breached three sections of the Act, because he was not only personal friends with the Kielburgers (which Trudeau was not), but Morneau gave them a lot of access to his department as a result of that friendship, and offered them very preferential treatment.

On the one hand, this defused a few of the prepared talking points, but it didn’t disarm all of them. The Conservatives insist that even if he wasn’t found to have broken the rules, the system is still “broken” and needs to be made even tougher, which they are going to regret when every interaction becomes a minefield and their own members start getting caught up in impossible situations should they form government, and it misses the mark of what the current problems are. The NDP, predictably, say that this proves the Liberals only care about their “rich friends,” which I’m not sure the Kielburgers really qualify as for obvious reasons.

Of course, as I have written before, the problem is not that the rules are too lax, but rather that the Liberals in their current incarnation have a culture that believes that so long as they mean well, that the ends will justify the means. No amount of tinkering or toughening up the rules can change that because it’s a cultural problem. It also doesn’t help that the definition of “corruption” has become so broad in the Canadian discourse that penny ante bullshit is treated as a capital crime, though very curiously, grift that is out in the open in places like Queen’s Park or the Alberta Legislature are not treated with the same kinds of howling denunciations that the WE Imbroglio has been. I also have to wonder what these same howlers would do if they saw the actual corruption that takes place in other countries, because it’s on a whole other level than anything that has happened here. And on a final note, this report does not mean that WE Charity was “destroyed” for nothing. The charity hasn’t been “destroyed,” and its dubious activities were brought to light by good reporting, not Charlie Angus’ antics at committee, and that’s a good thing. This incident helped to shine that spotlight. Let’s not confuse Trudeau’s exoneration with anything else that has happened to WE in the interim.

QP: Freeland vows to protect free expression

The Commons was a little emptier than the new normal of late, but as our rock of stability, Mark Gerretsen was again the only Liberal on the Chamber. Again. Candice Bergen led off in person, with a script in front of her, and she complained that Americans were getting together and attending packed sports stadiums while most Canadians were still “locked down,” and blamed the federal government’s inability to procure vaccines out of thin air. Chrystia Freeland reminded her that over twenty million doses have already arrived, and more were on the way. Bergen then read a bunch of blatant falsehoods about Bill C-10, for which Freeland assured her that as a former journalist, she understands the importance of freedom of expression and they would never endanger it, which this bill does not do. Bergen then raised Guilbeault’s blunder about “Net Neutrality,” and accused the government of trying to control speech, and Freeland repeated her response. Gérard Deltell carried on raising Guilbeault’s many blunders, and Freeland reassured him that everyone was against censorship, but they were concerned with the cultural sector. Deltell raised that Guilbeault keeps needing to correct himself, and Freeland repeated that as a former journalist, she would never limit freedom of expression, which the bill does not do.

Yves-François Blanchet rose for the Bloc, and he crowed about the Quebec government tabling a bill on protecting French, and Freeland read that the federal government recognises that the situation of French in Quebec is unique, and that they would study the bill in depth. Blanchet was disappointed that Freeland was insufficiently thrilled with the bill, and demanded a promise that the federal government would not challenge that bill in court. Freeland would not give him such an assurance.

Jagmeet Singh raised the blood deferral for men who have sex with men, and demanded to know why the prime minister would promise to overturn the ban and then not do it. Freeland assured him they support overturning the deferral, but they respect the authority of independent decision-makers and science. Singh complained in French that this didn’t make sense, but Freeland repeated her answer.

Roundup: The flailing incompetence of Ontario’s new sick days

If there was any doubt that the murderclowns in Doug Ford’s government were flailing incoherently, they announced a new paid sick leave programme yesterday, and wouldn’t you know it, it defies all common sense or logic. The idea is that employees get up to three days of paid sick leave – temporarily, because heaven forbid they stand up to the small business lobby and make this permanent – and employers can claim up to $200 per day for those employees, but they have to do it through the Workers Compensation bureaucracy, for some unknown reason. And we still have no idea what kinds of protections are actually in place for the workers if they use those days, because that’s a very big part of this. Furthermore, this was the province doing the bare minimum – they chose three days apparently because a) it’s what is currently in the Canada Labour Code for federally-regulated workers, and b) after three days, a person could claim the federal sickness benefit (because it pays out for the week), so they’re still trying to fob people off on to a system that was designed for those who can’t access employer-paid sick leave because they don’t have a traditional employer. And possibly the most galling part was how much the provincial labour minister was patting himself on the back for these woefully inadequate half-measures (which people were having to say was a “great first start” through gritted teeth all evening).

It shouldn’t have been like this. The easy fix was to simply allow sufficient days (probably up to ten given the current circumstances) under the provincial labour code, and employers could then access rebates either through the federal wage subsidy, as it’s been designed for, or a provincial stop-gap if they’re not currently on said subsidy, and it would have been easier, it would have protected jobs and workers’ rights, it would have been seamless, and we wouldn’t have the same problems that we’re having right now with those trying to access the federal benefit (which was not designed for these circumstances). But that would have angered the business lobbies, and Doug Ford would never want to do that, because they’re whom he considers the “little guy” that he looks out for. So here we are instead, with another badly designed system that seeks to do the bare minimum, and because this was done in haste, and with this government’s usual flailing incompetence, I suspect we won’t be out of problems with it anytime soon – just like everything else that has gone to wrong in this province, because it’s being run by incompetent murderclowns.

In case you were wondering what all of this flailing was trying to cover, it would be the Auditor General’s report on long-term care, which was a not unexpected recounting that there was a woeful lack of preparation, where long-standing problems quickly got amplified, while the ministry of long-term care was not prepared or equipped to deal with those issues. Again, not a surprise, but damning nevertheless. And what did the minister responsible for long-term care do? Blame everyone else including the NDP – who haven’t been in power since 1995 – for “starting the fire,” and she insisted that she was the one who ran into the burning building to save people, which…is a novel interpretation, especially considering that her government reduced the number of inspections and made things worse. Of course, we are in a system of Responsible Government, and she is the minister in charge of the portfolio, and guess what – she is responsible. If she had any modicum of shame or decency, she would tender her resignation for allowing the deaths of thousands on her hands, but this band of murderclowns are absolutely incapable of decency or shame.

QP: Those aren’t the transfers we’re looking for

On a slightly muggy Thursday in Ottawa, in the House of Commons, the Liberal benches were back down to three MPs, including two ministers, because we can’t have nice things. Erin O’Toole led off, script on his mini-lectern, and he decried delays in vaccines that have not materialised — mere rumours thereof — and he demanded a plan to end lockdowns. Rachel Bendayan reminded him that we are actually ahead of schedule on vaccine deliveries, and we had assurances from the European Commission. O’Toole raised the dosing directives — which is not a federal responsibility — for which Patty Hajdu launched into a spiel about science and evidence and how those evolve. O’Toole switched to French to repeat his first question, and Bendayan repeated her answer in French. O’Toole then returned to English to cite the Auditor General saying that this government shut GPHIN down, for which Hajdu countered with the expert panel report that said that problems with GPHIN did not affect when were alerted to the possible pandemic. O’Toole then repeated the question in French, and Hajdu spoke about the expansion of the Public Health Agency, and exhorted him to pass Bill C-14, which has more public health supports in it.

Alain Therrien led for the Bloc, and he declared that the announced one-time transfer to the provinces was not good enough, and he repeated their original demand of $28 billion without strings. Patty Hajdu reminded him of the other transfers and federal supports already given. Therrien was not mollified and demanded more, and got much the same response.

Jagmeet Singh rose for the NDP, and in French, raised the loss of seven women in Quebec over the past seven weeks to domestic violence, and demanded an end to this femicide. Maryam Monsef assured him that the government takes this seriously and listed some actions taken. Singh switched to English to decry that the government was not doing enough for climate change, for which Jonathan Wilkinson raised this morning’s Supreme Court of Canada ruling, and stated that the plans laid out are some of the most comprehensive in the world.

QP: Glad you’re keeping to your Queen’s Park roots

For proto-PMQ day, not only was the prime minister present, but there were six Liberals including two other Cabinet ministers — almost unheard of in the current situation. Erin O’Toole led off, scripts on mini-lectern, and he raised the scourge of domestic violence, citing a recent incident in Quebec, and Justin Trudeau readily listed off the investments that his government had made in combatting it. O’Toole then switched to the topic of the the delay between vaccine doses, claiming the federal government mandated the four-month gap — which they did not — and complained about the delay in doses arriving. Trudeau reminded him that NACI is arm’s length and they follow guidance while they have procured vaccines that are arriving. From there, O’Toole asked if the National Security Advisor was tasked with investigating the allegations against General Vance, for which Trudeau stated that allegations were sent to the proper authorities and that politicians should not be involved. O’Toole waved an email from the former Advisor in saying he was not alerted to the allegations, and Trudeau repeated that they always forward allegations to the proper authorities, and that they need to ensure there are resources and recourse for those who come forward. O’Toole repeated that question in French, and got much the same answer. 

Yves-François Blanchet raised a Quebec port that is damaged and can’t participate in crab season, for which Trudeau stated that they are working with local authorities to ensure the safety of fishers and those who use the facilities, and that they were doing everything they could to support them. Blanchet then moved to whether a high-frequency train route would be in the budget, for which Trudeau told him to wait for the budget, before offering a paean to the people in Trois-Rivières he met earlier this week.

Jagmeet Singh then rose for the NDP, and in French, he castigated other parties in the Commons for voting down their motion on removing profit from long-term care, and Trudeau chided that this is Ottawa and they have to respect provincial jurisdiction. Singh switched to English to repeat his plaintive wail, and he got the same answer.

QP: Demanding a “data-driven” plan to re-open

On a beautiful Tuesday in the Nation’s Capital, the prime minister was indeed in the Chamber for QP, along with fourth other Liberals, which was a very pleasant change of pace. Erin O’Toole led off in person, script on mini-lectern, and he raised the fatigue over lockdowns and the spectre of opioid overdoses, and true to his party’s Supply Day motion, demanded a “data-driven” federal plan for re-opening the economy. Justin Trudeau noted that the federal government has always been there for Canadians and would continue to listen to the recommendations of experts on re-opening. O’Toole tried to wedge a mental health angle, and Trudeau insisted that they stuck to the advice of science, and poked that some Conservatives didn’t even believe in masks. O’Toole then falsely accused the federal government of making a political decision around second doses, before accusing the federal government of being late on everything, to which Trudeau pushed back, citing that the provinces make the decision around spacing vaccine doses. O’Toole then repeated his first question in French, got much the same response in French, and for his final question, O’Toole accused the country of trailing behind. Trudeau took the opportunity to say that while O’Toole wanted a plan for the economy, he still doesn’t believe that the environment and the economy go hand in hand.

Yves-François Blanchet rose to for the Bloc, and after raising the announcement on high-speed internet yesterday, demanded higher health transfers. Trudeau reminded him that they have given higher transfers to the provinces in the pandemic and they would discuss future transfers after it was over. Blanchet then raised the panic over a certain obnoxious blow hard professor’s “Quebec-bashing,” but this time, Trudeau didn’t bite and returned to talk about federal supports for provinces. 

Jagmeet Singh then rose for the NDP, and in French, demanded an apology for General Vance getting a raise after allegations were raised against him, and Trudeau spoke about the importance of independent investigations. Singh switched to English to demand the government support their Supply Day motion on taking profit out of long-term care, to which Trudeau reminded him that under the constitution, this is a provincial responsibility.

QP: Bludgeoning about belief in climate change

It was heartening to see a few more bodies in the Chamber, but alas, there remained only a mere two Liberals — Mark Gerretsen and the designated front-bench babysitter, Catherine McKenna. Candice Bergen led off in person, and she spun a very dubious connection between continued lockdowns and federal actions or perceived lack thereof. Jonathan Wilkinson, surprisingly, answered and gave a brief speech about how climate change is real, in the wake of the Conservatives’ policy convention. Bergen then pivoted to the trials of the two Michaels, and demanded the government withdraw their participation in the Asian Infrastructure Bank, which Marc Garneau disputed, citing that these were a top priority, and thanked allies for appearing that the court houses in China in protest. Bergen railed that the government sent $40 million to the Asian Infrastructure Bank, and Garneau gave a stern warning to China about arbitrary detention. Gérard Deltell took over in French, and received pay increases given to General Vance after the allegations against him were raised, for which Harjit Sajjan stated that he doesn’t determine pay raises, but that it was done independently on the advice of the public service. Deltell tried again, and this time Sajjan raised testimony from Harper’s former chief of staff at the defence committee earlier in the day.

Alain Therrien rose for the Bloc, and demanded increased health transfers for the provinces, crocodile tears about the plight of nurses metaphorically streaming down his face, for which Patty Hajdu reminded him they are already giving increased transfers to the provinces. Therrien was not mollified, demanding increases, and in response, Hajdu listed assistance given to the provinces.

Jagmeet Singh then led for the NDP in person, and in French, he also raised Vance’s pay increase and demanded an apology, for which Sajjan repeated that he does not determine pay. Singh then switched to English to demand concrete action to end systemic racism in the RCMP, and Bill Blair gave his condolences to Colton Boushie’s family, and said that the Commissioner of the RCMP agreed to implement the recommendations of the report.
