Roundup: A swiftly-moving “stalled” bill

An odd narrative has been developing over the past few days about the budget implementation bill being “stuck” in the Senate, and that senators there are “holding it up” as the sitting days in the Commons tick down. And I’m really not sure where this impression comes from because the bill has only been there since Tuesday.

Quite literally, the bill was passed in the Commons on Monday, read in at First Reading in the Senate on Tuesday, passed Second Reading on Wednesday, and had the minister appear at committee on Thursday, and it was later that day that the motion to split the bill was voted on. (The Senate didn’t sit on Friday, for the record). If anyone can please explain how this is “holding it up” or “stuck,” I’m frightfully curious as to how exactly it works.

Justin Trudeau, meanwhile, went on The West Block yesterday and reiterated his praise for the Senate’s work and saying that he expected that this particular attempt to “alter” the budget bill is just “growing pains.” Err, except by altering, they are simply trying to split one section out so that it gets further study, so that the rest of the budgetary elements can get passed, while the section that does need further study gets it. That’s not exactly a major alteration, and they’re not looking to kill that section of it either – just ensure that it’s going to work like it’s supposed to. But then Trudeau insisted that it’s a well-established practice that the Senate always defer to the Commons on money bills.

The hell it is. Constitutionally, the Senate can’t initiate money bills, but that doesn’t mean they simply defer on all of them. Hell, the very first bill they passed in the current parliament were the Supplementary Estimates (which is a money bill), and lo, they had to send it back to the Commons because they forgot to attach a crucial financial schedule to it. Should they have deferred to that flaw? Yes, the Commons is the confidence chamber, and the chamber of “democratic legitimacy,” but Trudeau is conflating a number of different things here, and it’s a bit disappointing because he should know better.

And I will remind everyone that this current Senate, no matter how many bills it sending back with amendments, is still nowhere near as “activist” as the Senate was in the Mulroney days, where they forced him to an election over the free trade agreement and to use the constitutional emergency powers to appoint an additional eight senators in order for him to get the GST passed. The current iteration of the chamber, while they are sending more bills back with amendments, will inevitably defer. That the government is accepting many of those amendments shows that perhaps *gasp!* it was flawed legislation to begin with (not that the Harper government using its illegitimate whip over their senators to pass bills made them any better, because their court record shows they weren’t).

But if we could have fewer terribly media headlines putting forward a patently false narrative about what’s going on in the Senate right now, that would be grand.

QP: The non-existent plan for a non-existent tax

Despite it being a Thursday, the only leader in the Commons was Elizabeth May — because reasons. Candice Bergen led off, demanding an admission that the government ignored American warnings about the Norsat sale. Navdeep Bains assured her that they followed the process and took the advice of our security agencies, who did consult. Bergen wasn’t buying it, but Bains reiterated his point about the process before touting improved economic progress thanks to their being open to trade. Bergen then accused the government of proposing an internet tax, which was entirely disingenuous because it wasn’t the government who floated the idea — it was a committee of backbenchers. Mélanie Joly assured her they would not levy such a tax. Alain Rayes asked the same again in French, got the same answer, and then reiterated the Norsat question in French. Bains repeated his previous points in French, reading from a prepared response. Matthew Dubé led for the NDP, wondering when reforms to the Anti-terrorism Act would finally be tabled. Ralph Goodale assured him that new legislation was on the way. Dubé switched to English to ask again, adding in a clause about lawful access. Goodale accused him of trying to spook people with innuendo, and that the legislation would keep Canadians safe while protecting their privacy rights. Brian Masse raised the Norsat sale, and Bains repeated his same answer. Alexandre Boulerice then raised a question of an EI case, and Jean-Yves Duclos asked him to forward him the details so that he could look into it.

QP: The Trudeau/Scheer damp squib

A new week, and Justin Trudeau was back in the Commons after a morning at Niagara Falls to do a guest spot on US television, and before his meeting with the visiting president of Chile. After a moment of silence for the victims of the London Bridge attack, Andrew Scheer led off, mini-lectern on desk, asking for an update and reaction to the attack. Trudeau gave condolences to the family of the Canadian woman who died in the attack, and noted that an hour before, he had spoken to Theresa May about the issue an hour before, and then offered his well wishes to Scheer as new leader of the Opposition. Scheer then turned to the Infrastructure Bank, and concerns that it would assume all risks with future projects. Trudeau didn’t really answer, but talked about the need for more infrastructure investments across the country. Scheer insisted it was all about rich friends of the PM, but Trudeau reminded him that they raised taxes on the wealthy to lower taxes on the middle class. Scheer then changed topics to ask about the politicised nomination of Madeleine Meilleur as Language Commissioner and demanded that it be cancelled. Trudeau said that it was important to get the right people for the job, regardless of their political history — a new talking point. Scheer tried again in English, and Trudeau dug in a little more this time, pointing out how politicised the previous government’s appointment process was whereas the current government had created a new process. Alexandre Boulerice led for the NDP, railing that the Infrastructure Bank would necessitate user fees, and Trudeau stuck to points about the need to invest in infrastructure. Daniel Blaikie repeated the question in English, and Trudeau noted that the Federation of Canadian Municipalities was applauding the decision to unlock more capital in that way. Blaikie then turned to the Meilleur nomination, and Trudeau repeated his points about merit-based appointments. Boulerice repeated Blaikie’s question in French, and Trudeau repeated his answer.

Roundup: More BC Speaker cautions

The question of the Speaker of the BC Legislature remains up in the air, and continued word is that the Liberals are keeping their own out of the race lest they lose another seat as they test the confidence of the legislature, and with the Greens ruling out one of their own as well, that leaves the NDP left holding the bag when it comes to electing a Speaker. They’re obviously reluctant to do so, but it also reduces their chances of toppling the government and installing one of their own. And with that reality in mind, there is dark talk about the NDP turning the Speaker into a partisan if that happens.

This kind of comment is a real problem, because in a Westminster system, the conventions are the rules. And when people don’t see an issue with the Speaker breaking the convention that they only vote to break a tie, and in a manner that either keeps debate going or to preserve the status quo, demanding that an NDP Speaker topple the Clark government is a very big problem.

And if an NDP Speaker is elected but doesn’t opt to topple the government (and they very well should not for the sake of our system), it could leave Clark with little ability to govern, especially when it comes to passing supply, but that could be exactly what Clark is waiting for – an ability to go back to the electorate with great public regret. That said, she is under no obligation to simply accept defeat and turn over power to the NDP, especially with a precarious situation (signed confidence agreement or not).

I will add that the BC Liberals are under no obligation to put forward a name for Speaker. Federally, the Conservatives served two minority terms under Peter Milliken, a Liberal Speaker, with no ill-effect. So no, nothing is over or settled on this yet.

Roundup: Scheer in ascendance

As you know by now, Andrew Scheer is the new leader of the Conservative Party, somewhat unexpectedly after he managed to squeak out a win over Maxime Bernier by getting 50.95 percent of the votes on 13 ballots. Scheer is described as “Stephen Harper with a smile” – in fact, no one in the party can recall him actually having anything but that cherubic smile on his face. While the next couple of days will be filled with portraits of Scheer, already many of his supporters note just how “middle class” he is next to Trudeau, though I’m not sure how well it tracks considering that he’s spent most of his adult life in politics, most of his children’s lives has been spent living in official residences (as they move into another one), and they attending private Christian school, while Trudeau’s go to regular public school.  That Scheer has five children is a tangible signal to his social conservatism – and it was mostly the social conservatives who voted for Brad Trost and Pierre Lemieux who pushed Scheer over the top.

As for the event, the fact that it was held in the same venue as Anime North made for some excitement, and there were a few crossover attendees (who, surprise, surprise, didn’t like panels on feminism at Anime North). The National Post spoke to eight cosplayers from the convention to see their views. In the speeches, it was noted that Bernier’s fell flatter, while Scheer hit the right notes, in the event that it mattered to any of those party members who were going to vote on-site rather than had mailed in their ballots previously. For his victory speech, Scheer took aim at Trudeau, but also sounded more than a few populist notes that didn’t have a lot of good economic backing. The Liberals, meanwhile, were quick to jump on Scheer’s record of social conservatism, and are already digging up things like his pro-Brexit stance or his desire to defund CBC News because he considers it propaganda when they don’t adopt Conservative terminology for things (such as not calling carbon prices a “tax”). And this is even before we mention his full-throated adoption of the alt-right weaponization of free speech on campus, with his threat to cut off federal research dollars to campuses that “don’t allow free speech” (which seems to largely mean either those who have clashes with Ann Coulter, or who don’t allow pro-life clubs to distribute gore-filled flyers).

In the aftermath, Susan Delacourt wonders about party unity if there are fewer carrots than sticks as the party is not in power. Natalie Pon, the young Conservative who led the party’s charge to change its policy on same-sex marriage, is cautiously optimistic about Scheer. Paul Wells looks at the challenges facing Scheer going forward, while Andrew MacDougall tries to discern what the contest results says about the state of the party. Brent Rathgeber says that Scheer will be beholden to the social conservatives in the party. Andrew Coyne suspects that Scheer’s election means the party is more hostile to new ideas, while Chris Selley wonders if they can be more confident in their diversity of conservatism.

Roundup: Wrongheaded notions about party policy-making

Over at Policy Options yesterday, Stephen Harper’s former policy director, Rachel Curren, lamented the policy-making process of the Conservative Party, sighing about the fact that the majority of the leadership candidates were just retreads of Harper-era policies. But sweet Rhea mother of Zeus was her op-ed full of so many mistruths about the Westminster parliamentary system, that my head about exploded.

While Curran was disingenuous about how the Conservatives were the party of grassroots policy-making that the Liberals were top-down (that has not been the case until they changed their policy process just last year, which is a problem), the crux of her article rested on this notion that the party needed some outside policy groups or think-tanks to do the heavy policy lifting for them because they were just too cautious a group to do it otherwise.

No.

The notion that it’s not the role of the party itself to engage in policy development, but rather to fight and win elections, is complete and utter bullshit. Likewise, it’s not up to the civil service to come up with policy either – they can offer advice and options for implementation, but political policy is certainly not their job.

It is absolutely the role of the grassroots to engage in policy development because that’s their job. Politics is supposed to be about bottom-up engagement, both in terms of policy development and in the selection of candidates (and removal of incumbents when necessary). And what utterly boggles my mind is the notion that Curran is peddling that we should take away what little power the grassroots has left and pass it off to these third-party think-tanks that can access the kind of funding that parties can’t, and have little accountability. If we take this away from the grassroots, then what good are they? Continuing the farce of our illegitimate leadership selection process to coronate unaccountable presidential figures who can then dictate top-down policy and control over the party (and if you don’t think they’re not dictating policy, then why the hell are they running on it in this gong show of a leadership contest)? These contests actively disenfranchise the grassroots (despite all appearance to the contrary), so taking away what policy powers they have left leaves the grassroots with what? Being donors with no say in what they’re donating to? How is that any way to run our political system?

This kind of stuff infuriates me because it’s not the way politics is supposed to happen. The grassroots are supposed to be empowered, and leaders are supposed to be responsive to them – not the other way around like it is now. It’s a problem and it’s one we need to fix, and hey, I just happened to have written a book all about these kinds of issues, which I would suggest that Curran read, because she might learn a thing or two.

Roundup: Senator Greene’s grievous error

The strange fascination with Senator Stephen Greene’s ouster from caucus has consumed far too much time and attention, and yet things keep cropping up that demand a response. Today it was his op-ed in the National Post describing what happened, and then he dropped this little gem at the end of his piece.

No. Greene is completely and utterly wrong.

The Senate may not be the confidence Chamber – that is rightfully the House of Commons – but that doesn’t mean that the Senate doesn’t play an accountability role because the whole point of Parliament is to hold the government to account. The Senate is part of Parliament. This is elementary civics for a Westminster democracy.

The way in which the Senate exercises its accountability role is different from the Commons, but it exists nevertheless. It’s not a copy of the Commons’ processes either, nor can it be redundant because composition matters. Sober second thought is actually a form of accountability that relies on checking government legislation from a less partisan lens that is removed from the grasping for votes that afflicts most MPs, for whom populist considerations can blind them to bad policy – something the Senate can call out by virtue of the fact that they’re not seeking re-election.

That institutional independence – not seeking re-election, tenured so that they can’t be easily removed by the government of the day, given job security until age 75 so that they’re not compromising themselves in seeking post-Senate employment – it all adds up to the ability to hold the government to account in a way that the House of Commons simply cannot do. That’s why the Senate has the unlimited veto power that it does – because sometimes a government with a majority will pass blatantly unconstitutional legislation because it’s politically popular to do so, but as we all know, populism is not democracy, and the Senate safeguards that principle. That is an accountability function.

That Greene is unable to make that distinction is a problem, and it’s especially a problem because he’s been leading the charge with the modernisation push in the Upper Chamber, and his is a vision that is looking to see partisan caucuses diminishing. As I’ve said on numerous occasions, the ability to have a coherent opposition in the Senate is a key Westminster feature and a guarantor off accountability, which simply cannot be done effectively if the Chamber is a collection of 105 loose fish. That the Senate is more vigorously examining and amending legislation now is not a bad thing, but we are probably at the peak of what we can or should be expecting in terms of activism without senators engaging in overreach. But to think that this isn’t accountability is simply ignorant.

QP: Rona Ambrose’s swan song

With the news that Rona Ambrose was stepping down now confirmed, and Justin Trudeau present for what was likely the only day this week, QP was off and running. Ambrose led off, asking about the report calling to scrap and replace the National Energy Board. Trudeau noted that they have been consulting, and reiterated that they are serious about ensuring that the economy and the environment go together. Ambrose took exception to the report recommendation that its headquarters be moved to Ottawa from Calgary, and Trudeau took a few shots at the previous government politicising the Board while he was working to restore trust in the process. Ambrose worried that Trudeau was trying to choke out the oilsands in red tape, but Trudeau insisted that a responsible approach would mean growing the economy. Ambrose switched to French to demand that the House appoint a new Ethics Commissioner without any Liberal interference. Trudeau jabbed back about political appointments the Conservatives made while touting his own merit-based process. Ambrose noted that the last question would likely be her final one as leader of the opposition, and said she would call off her attack dogs if he answered how many times he met with the Ethics Commissioner. Trudeau reminded her that she asks them not to talk about investigations and he has met with her several times over his time as an MP, and was going to pay Ambrose a compliment before he was drowned out. Thomas Mulcair was up next, raising the reach of a CBC news story about the ownership of the Aga Khan’s island. Trudeau retreated to the talking point that it was a private family vacation. Mulcair railed about the helicopter ride, but Trudeau noted that he would answer any questions the Ethics Commissioner may have. Mulcair then moved onto the story about someone from KPMG working for the Liberal Party, in the context of a committee study of the firm being voted down, and Trudeau noted that the committee is independent. Mulcair pressed, and Trudeau launched into a spiel about ethics and openness.

Roundup: A couple of thoughts on the BC situation

Given the (likely) minority government result in British Columbia last week, a number of people have been trying to game out various different scenarios for how this all might happen. Meanwhile, media everywhere are flocking to hear what the Green Party has to say, with their apparent balance of power, while Elizabeth May in Ottawa keep spouting this laundry list of things that apparently 57 percent of British Columbians voted for, despite the fact that there is no actual proof that those voters all voted for those very things, be it electoral reform or stopping the Kinder Morgan pipeline expansion. Nevertheless, when UBC economist Kevin Milligan asked my thoughts, here is what I told him:

I do think the fact that the legislature won’t sit until October is a key factor. BC has always been a bit weird about this, and there has been a lot of wailing and gnashing of teeth from some political scientists over social media that there is a pattern of cancelling the spring session of the BC legislature and few people seem all that bothered about it, while Christy Clark seems to make it sound like it’s such a terrible imposition that they have to bother sitting at all, which is weird and uncool for a democracy.

There is a burgeoning convention that if it’s been six months, that it’s more likely that the GG or the lieutenant governor will call an election rather than entertain an attempt by the opposition to form government. And what I meant by how leaders perform in the meantime is whether there are any temper tantrums (particularly from the NDP leader, who has been fighting a reputation for being a hothead throughout the campaign), and that will weigh on how the public perceives any kind of government arrangement – we did live through this in Ottawa in 2008, and the fact that Harper mostly kept his cool while Stéphane Dion went apoplectic certainly helped Harper’s case with the general public. As I also mentioned, I have a suspicion that the Greens will try to overplay their hands in trying to get a bigger share of the governing pie, and making a list of demands that may not be saleable to Clark. Of course, the moment that happens, she has ammunition to go back to the voters to say “look at how unreasonable these people are, and they want to destroy the economy, so you need to give me a real majority mandate.” We’ll see if any of this happens, but this is pretty much what I have to say on the matter for now.

Roundup: The hole that the Forces find themselves in

While I noted that this was certainly used as an attempt to change the channel during QP yesterday, I wanted to spend a couple of more minutes talking about the big defence policy teaser that Harjit Sajjan gave yesterday, which basically made the perennial statement that the previous government didn’t do a very good job, which is why we’re in such a terrible mess. All governments say this, and future governments will too. And while Conservatives in my reply column get indignant, and while Rona Ambrose emailed her own fact-check, it too contains a lot of rose-coloured history.

Ambrose mentions things like the Leopard 2 tanks (the decision to purchase which were questioned considering it’s obsolete Cold War era technology bought for a counter-insurgency war), the Cyclone helicopters (which were problem-plagued and didn’t even have shielded electronics, which were easily knocked out by the radar on our frigates), the new Arctic Offshore patrol ships (known affectionately as “slushbreakers” because they can’t even cut through the ice in a gin and tonic and yet they’re supposed to be used for Arctic operations), and then there are the supply ships which they cancelled, leaving us with no supply capacity in our navy. So yeah, they did so much with their investment in the military.

Much of the reaction to Sajjan’s speech was that yes, we’re in a hole, but the government hasn’t committed to reinvesting either. Partly they have, with the earmarked dollars that will follow once there is a plan in place. That plan will be part of the actual rollout of the Defence Policy, and the prime minister acknowledged in QP yesterday that investment in the military would follow the policy, and yes, the policy is important to have in place first because it’s hard to plan to spend if you don’t know why you’re spending or what the plan is for our Forces to be doing. So it makes sense to wait for a plan before there are dollars to follow it. It should also be noted that this government is not following the more recent trend of putting all of its plans in the budget, so we may yet so more dollars flowing (but it remains to see how many dollars, considering the fiscal situation).

All of this being said, we will still need to acknowledge that funding likely won’t be enough to completely get things back on the right track, and that complaints about underfunding will continue into future. This new funding likely won’t even get us close to our 2 percent of GDP NATO target (not that such a target counts for a lot). Suffice to say, I’m not sure that any party should be patting themselves on the back.
