Roundup: Lighting a fire under the minister

It’s been a year since the Supreme Court of Canada decision in Jordan, which set upper limits for trial delays, and so The Canadian Press had a couple of good pieces on it today, both looking at the fallout in terms of what needs to change in the justice system, as well as looking at the numbers of cases that have applied or been granted a stay of proceedings owing to delays that have been deemed unreasonable. I will note that while justice minister Jody Wilson-Raybould says that the decision “lit a fire” under her, she’s been agonizingly slow in responding.

I write a lot for the Law Times, and I talk to a lot of players in the legal community, and there has been a sense of mystification as to what all of the delays are. The fact that it took her a year to start the process of reforming how judges are appointed was baffling, and that slowed down the process for making said appointments – especially as some of the committees advising on appointments still aren’t up and running, six months later. While more appointments are finally being made, it’s taken a long time and it’ll take even longer for those judges to be fully prepared and worked into the system.

There is the legislation that has been coming out in drips and drabs. For example, they made a big deal about a bill that would finally equalise the age of consent for gay sex, but then abandoned said bill to roll those provisions into a larger bill on doing away with “zombie laws” that have been struck down but remain on the books. How much time and energy was spent on that abandoned bill? We keep hearing about the big promised justice reforms promise – looking at the Criminal Code, sentencing, bail, the works, but we’re nearly two years in, and there’s still no sign of them. Yes, they’re big files, but this is nearly the halfway point in the mandate, and big, complicated files like that are going to take time to get through Parliament – especially in the more independent Senate where they will face pushback from law-and-order Conservatives who are looking to hold onto the “reforms” of the previous government.

And then there are the whispers about Wilson-Raybould’s office. There is a constant churn of staff, but not before great delays when it comes to actually filling positions, like the judicial affairs advisor – a pretty key role that took months and months to fill. And if these kinds of necessary staffing decisions are taking forever, what does that mean for the managerial skills of the minister? There are whispers in the legal community, and they’re not too flattering. So when Wilson-Raybould says that Jordan lit a fire under her, one shudders to think about the pace of progress had it not.

Roundup: Challenging an unconstitutional law

The saga of Steven Fletcher in Manitoba continues to fascinate and enrage me. The now-former member of the province’s PC caucus, and one-time federal Conservative cabinet minister, has not only run up against a very problematic expulsion from caucus because he dared to have differing opinions (which I wrote about in my column), but now it appears that Fletcher is planning to challenge the province’s law that bans floor-crossing. Not that he wants to cross the floor, but the fact that the law is on the books.

In case it’s not clear, the very notion of a legislated ban on floor-crossing should be unconstitutional. Apparently, Manitoba’s not the only province to have this either – New Brunswick has a law on the books that requires floor-crossers to reimburse their former party for election expenses, which is also legally dubious. The history of these laws is also circumspect at best – in Manitoba, it was allegedly cashing in on the anger around David Emerson crossing the floor to become a federal Conservative cabinet minister in 2006, while in New Brunswick, it was the angry response to a husband-and-wife MLA couple crossed from the provincial Conservatives to the Liberals. The Manitoba case has the added factor that it was an NDP government at the time, and the NDP are particularly hostile to floor-crossers, which one suspects has to do with the fact that they are a party that is big on solidarity and being in constant lock-step, and they aren’t very tolerant of their members stepping out of line. They’re also much more wrapped up in their party identity, which is part of why these laws are such a problem.

The thing with our electoral system is that it gives individual agency to MPs. They are elected as individuals, to fill a single seat in the House of Commons in a separate election. That’s why a general election is 338 separate elections federally, or however many seats are in that province’s legislature during their elections. MPs are not elected a party vote which then gets allocated to that seat, and this is important. Because we elect MPs as individuals, regardless of whatever party colours they may be wearing, it empowers them to make their own decisions in Parliament (or their provincial legislature), and that includes the ability to cross the floor when their conscience is so moved. It’s not a bug in our system – it’s a feature because it means that the individual is more powerful than the party. The NDP doesn’t like this line of thinking at either level of government, and apparently the provincial Liberals in Manitoba are also under the misguided notion that it’s “unconstitutional” (which it most certainly is not). I’m glad that Fletcher is planning to challenge the law, because it is an affront to Westminster democracy. And when it does get struck down, I hope it serves as a warning to other provinces, or the federal NDP in their perpetual quest to enact such laws.

Roundup: PBO’s platform peril

Now that the budget implementation bill has passed, the Parliamentary Budget Officer is in the midst of transforming into yet another unaccountable Officer of Parliament that will have a broad mandate and few checks on his actions, given that the government backed down on their attempts to limit the scope of his work. What they didn’t limit was the giving the PBO the mandate to cost election promises by other parties, despite his objections to doing so, and so now his office is being forced to figure out just how they’ll do it. The legislation does make it clear that he’s only to cost individual promises, not their whole campaign, but it’s going to be an enormous amount of work that will be used even more as a cudgel than his work already is, and we can expect an election period being filled with taunts of “See, the PBO says that your plans will cost more than you say and he’s independent,” with the unspoken “Nya, nya!” in there. Oh boy. Anyway, Jennifer Robson has a few more thoughts on the issue.

The bit about a common baseline is possibly important, given that economist Stephen Gordon has been trying to match Liberal election promises to the current budget framework and has found the task to be nigh impossible.

Enforcing common costing baselines may sound like a good idea, but it does make me nervous about campaigns devolving into accounting exercises at the expense of other considerations, including accountability, and that we’ll have repeats of 2008, when we had clear platform commitments shrugged off by reporters going “it’s just so complicated” when a) it wasn’t, and b) it reinforces this “math is hard” narrative that does nobody any favours. But maybe that’s just me.

Roundup: Trudeau laying in the Senate bed he made

There is a renewed round of wailing and gnashing of teeth about the Senate feeling it oats and flexing its muscles, and yesterday it was the Prime Minister doing it. Apparently deliberating and amending bills is fine unless it’s a budget bill, in which case it’s a no go. The problem with that is that of course is that a) there is no constitutional basis for that position, and b) if the whole point of Parliament is to hold the government to account by means of controlling supply (meaning the public purse), then telling one of the chambers that it actually can’t do that is pretty much an existential betrayal. So there’s that.

But part of this is not so much about the actual issue of splitting out the Infrastructure Bank from the budget bill – which Senator Pratte, who is leading this charge, actually supports. Part of the problem is the principle that the Senate isn’t about to let the Commons push it around and tell them what they can and can’t do – that’s not the Commons’ job either. As Kady O’Malley delves into here, the principle has driven the vote (as has the Conservatives doing their level best to oppose, full stop). But some very good points were raised about the principle of money bills in the Senate, and while they can’t initiate them, that’s their only restriction, and they want to defend that principle so that there’s no precent of them backing down on that, and that’s actually important in a parliamentary context.

As for this problem of Trudeau now ruing the independent Senate that he created, well, he gets to lie in the bed that he made. That said, even as much as certain commenters are clutching their pearls about how terrible it is that the Senate is doing their constitutional duties of amending legislation and sending it back, it’s their job. They haven’t substituted their judgment for those of MPs and killed any government bills outright and have pretty much always backed down when the Commons has rejected any of their amendments, and that matters. But it’s also not the most activist that the Senate has ever been, and someone may want to look to the Eighties for when they were really flexing their muscles, enough so that Mulroney had to use the emergency constitutional powers to add an extra eight senators to the Chamber in order to pass the GST – which was a money bill. So perhaps those pearl-clutchers should actually grab a bit of perspective and go lie down on their fainting couch for a while.

On the subject of the Senate, it’s being blamed for why the government hasn’t passed as many bills in its first 18 months as the Harper government had. Apart from the fact that the analysis doesn’t actually look at the kinds of bills that were passed (because that matters), the reason why things tend to be slow in the Senate is because the Government Leader – err, “representative” – Senator Peter Harder isn’t doing his job and negotiating with the other caucuses and groups to have an agenda and move things through. That’s a pretty big deal that nobody wants to talk about.

Roundup: The disingenuous framing of a committee report

As you may have heard, the Heritage Committee released their long-awaited study on suggested ways to help the local media landscape in Canada. And I’m not here to talk about that, however, but rather how the narrative got completely spun into “Netflix tax!” or “Internet tax!” which wasn’t exactly what they were proposing either. Still, it became a convenient cudgel by which to try and bash the government with.

And that’s the bigger problem with this whole affair – that a committee report is being used to paint the government when it’s backbenchers who are on the committee. That separation between government (meaning Cabinet) and a committee of the legislature is important, and conflating the two is being wilfully disingenuous and makes the problem of not understanding how our parliament works even worse.

Paul and Aaron both have some very valid points. When the opposition frames it as “Netflix tax!” it’s sadly how most media will report it as well, and I didn’t see a lot of corrections going on about what the report actually said, and that’s a problem. But Aaron also has the point about how the media loves to jump on differences of opinion in parties, but when the parties themselves frame the issue, the media often gets swept up in those narratives.

Remember when there were those Conservative backbenchers trying to float some backdoor abortion legislation or motions that the government distanced themselves from but the NDP screamed bloody murder about hidden agendas and so on? This is not far from the same thing. And they know they’re being disingenuous, but they’re doing it anyway, no matter how much they’re actually damaging the perceptions of the institution.

That said, I could be really mean and point out that it may be hard for the Conservatives to tell the difference between backbenchers on a committee and the government seeing as during their decade in office, they essentially turned the committees into branch plants of the ministers’ offices with parliamentary secretaries ringleading the show and completely destroying their independence…but maybe I won’t.

Roundup: Cullen’s plan to launder accountability

The NDP used their Supply Day motion yesterday to call for a new process to vet nominations for Officers of Parliament using a newly created subcommittee of Procedure and House Affairs that would have one member from each recognized party to vet the nominees. And while you may think on the surface that this is innocuous, there are plenty of problems with this proposal that go to the core of our system of Responsible Government.

For starters, the original motion was absolutely a veto, despite Nathan Cullen’s protests, and that’s not entirely appropriate given our system. They negotiated an amendment to remove that section, but the Liberals decided they weren’t going to agree to the motion in any case, which is fine because the veto wasn’t the bigger problem.

The problem is that a committee like this will not actually bring other parties into the process to make it “non-partisan,” but rather, it will launder the government’s responsibility for the appointments so that it becomes impossible to hold them to account when things go wrong. Remember when the Public Sector Integrity Commissioner, Christiane Ouimet, turned out to be a giant problem? Do you remember what the government said when it came up in QP? They said “We consulted and no one raised any objections then – not our problem,” which was untrue. Add this process in, and that “not our problem” becomes baked in. At least this government has enough of a shred of decency when it comes to our parliamentary system to not look to find a new solution to wash their hands of future accountability, because that’s all that this motion offers – aside from the ability for opposition parties to engage in shenanigans of their own on the nomination sub-committee. And this isn’t even mentioning the fact that for many of these Officers, they serve Parliament as a whole, so a process that excludes senators becomes even more problematic for the functioning of our system.

To try and tie this to what happened with Madeleine Meilleur is a bit of a red herring – through the established process, it became clear to everyone (except maybe Mélanie Joly) that Meilleur simply wasn’t suited, most especially after she managed to alienate Anglophone Quebeckers – an extremely difficult thing to do, and yet she managed, and with the Senate lining up to vote against her appointment, it pretty much proves that the existing system worked.

No, this is about this farcical notion that people like Cullen keep pushing about how this is all about “making Parliament work.” It already works when the players involved do their jobs, and creating new processes creates added complications and unintended consequences, like the laundering of accountability, which nobody thinks about or raises as an issue because few people bother to learn how the system works. This Americanized suggestion is flash in the pan, trying to capitalize on what was clearly a blunder that the existing system nevertheless corrected. And if people had any good sense, they’d stop listening to Nathan Cullen’s attempts to “improve” our democracy.

Roundup: The looming retirement of the Chief Justice

Chief Justice Beverley McLachlin announced yesterday that she would be retiring on December 15th, a few months in advance of her mandatory retirement date, in order to give the government enough time to find a suitable replacement. Why that date is significant is because it will be at the end of the Court’s fall sitting, letting her use the next six months that she is able to clear off the files from her desk and work on any outstanding judgments rather than depart mid-sitting and the organizational chaos that would follow.

The next steps are now an important consideration. The government will not only have to name a new Chief Justice, but a new judge from Western Canada (and likely BC given that’s where McLachlin was appointed from). And in order to keep gender balance on the court it will likely have to be a woman, and in accordance with this government’s push for diversity, it will likely be a person of colour, if not someone Indigenous (and let us not forget that said person must also be fluently bilingual, which is another self-imposed criteria that this government has made for itself). This may be easier to find in BC than it was in Atlantic Canada, mind you. And for Chief Justice? My money is on Justice Richard Wagner, whom I know many close the court have already tapped as being the successor if they had their druthers.

Of course, we’ll see if this government can get an appointment process back up and running within the six months. Experience has shown us that they seem to have difficulty with that, especially as there are still some sixty or so federally appointed judicial vacancies still remaining around the country, and a few of the Judicial Advisory Committees charged with finding candidates for said vacancies still not fully appointed either, which is a problem. Of course, they may be able to largely reconstitute the committee that oversaw the nomination of Justice Rowe, with Kim Campbell again in charge of the process, but I guess we’ll see how long that takes.

Roundup: Wrongheaded notions about party policy-making

Over at Policy Options yesterday, Stephen Harper’s former policy director, Rachel Curren, lamented the policy-making process of the Conservative Party, sighing about the fact that the majority of the leadership candidates were just retreads of Harper-era policies. But sweet Rhea mother of Zeus was her op-ed full of so many mistruths about the Westminster parliamentary system, that my head about exploded.

While Curran was disingenuous about how the Conservatives were the party of grassroots policy-making that the Liberals were top-down (that has not been the case until they changed their policy process just last year, which is a problem), the crux of her article rested on this notion that the party needed some outside policy groups or think-tanks to do the heavy policy lifting for them because they were just too cautious a group to do it otherwise.

No.

The notion that it’s not the role of the party itself to engage in policy development, but rather to fight and win elections, is complete and utter bullshit. Likewise, it’s not up to the civil service to come up with policy either – they can offer advice and options for implementation, but political policy is certainly not their job.

It is absolutely the role of the grassroots to engage in policy development because that’s their job. Politics is supposed to be about bottom-up engagement, both in terms of policy development and in the selection of candidates (and removal of incumbents when necessary). And what utterly boggles my mind is the notion that Curran is peddling that we should take away what little power the grassroots has left and pass it off to these third-party think-tanks that can access the kind of funding that parties can’t, and have little accountability. If we take this away from the grassroots, then what good are they? Continuing the farce of our illegitimate leadership selection process to coronate unaccountable presidential figures who can then dictate top-down policy and control over the party (and if you don’t think they’re not dictating policy, then why the hell are they running on it in this gong show of a leadership contest)? These contests actively disenfranchise the grassroots (despite all appearance to the contrary), so taking away what policy powers they have left leaves the grassroots with what? Being donors with no say in what they’re donating to? How is that any way to run our political system?

This kind of stuff infuriates me because it’s not the way politics is supposed to happen. The grassroots are supposed to be empowered, and leaders are supposed to be responsive to them – not the other way around like it is now. It’s a problem and it’s one we need to fix, and hey, I just happened to have written a book all about these kinds of issues, which I would suggest that Curran read, because she might learn a thing or two.

Roundup: Neglecting our Canadian Sovereign

It was Victoria Day yesterday, which is a uniquely Canadian holiday that both celebrates the “mother” of Confederation, Queen Victoria, as well as acts as the official birthday of the Canadian monarch (no matter when their natural person’s birthday is). You might find it strange to find that in his message for Victoria Day, the Governor General didn’t reference the Queen of Canada at all, but rather the forthcoming Sapphire Jubilee and her being the first British monarch to achieve it.

Why does this matter? Because the Queen of Canada is a separate legal entity from the Queen of the United Kingdom, and because the holiday celebrated the Queen of Canada’s official birthday. Now, there were quibbles with my tweet pointing out the fact that the GG made the omission, but I maintain that the bigger point stands.

And Lagassé is correct in that – the emphasis is curious, and part of a troubling trend from the Canadian government, which has only exacerbated since the Liberals came to power.

While the Conservatives did a lot to bring some of the focus back to the Canadian monarchy after a couple of decades of neglect and the conscious effort to “Canadianize” a number of institutions by dropping their Royal monikers (like the Royal Canadian Navy being changed into “Maritime Command” for example, until the Conservatives restored its original name), they too did their own damage to the institution, primarily when they made the utterly boneheaded decision to pass legislation that when it came to changing the line of succession to include female heirs and those who are Catholics, they merely assented to British legislation rather than amending it in Canada. In other words, they turned what was control over our own Crown and Sovereign, and undid all of the progress we’ve made since the Statute of Westminster in 1931, when the Canadian Crown became separate from the UK Crown, and turned us essentially into Tuvalu when it comes to our relationship with the Crown, and thus far, the Courts have sided with the government when it comes to the challenges of this legislation, because the appreciation of the distinction and the role of the Canadian Crown remains largely ignorant to the vast majority of Canadian society, the judiciary included. (Incidentally, that was another bill that the Commons passed at all stages with no debate, and while it was debated in the Senate rather than veto it and tell the government that the proper way to change the law of succession is by way of constitutional amendment).

Meanwhile, the current government hasn’t named a new Canadian Secretary to the Queen since the last one retired, and has been letting the republican bureaucrats in the Department of Canadian Heritage run roughshod over the relationship with the Royal Family. And because the vast majority of Canadians don’t know any better, we’re slowly killing our distinct Crown and turning ourselves back into a mere colony. So yeah, it does matter that the GG couldn’t get this very basic thing right, and we should be upset about it.

Roundup: An unconstitutional motion

As stated for their upcoming Supply Day motion (currently scheduled for Monday, the Conservatives have drafted a resolution that would see the House of Commons express non-confidence in Minister Sajjan and Minister Sajjan alone. It’s the kind of thing that makes me want to bash my head into a wall before my head explodes because it’s so very boneheaded from start to finish.

First of all, you should read this post by James Bowden, who takes apart the motion to and shows that it is unconstitutional. What is more interesting is the fact that the NDP tried this tactic before when Rona Ambrose was minister of the environment, and the Speaker ruled it out of order then, just as Speaker Regan should this time. Why? Because one of the fundamental tenets of Responsible Government is that of Cabinet solidarity. Cabinet lives and dies as a single body – there is no dispensation given to ministers we like, or to simply cull the prime minister from the rest of them in these kinds of votes. It’s an important feature of why the system works the way it does, and trying to cherry pick it for the sake of political tactics makes one a bit queasy because this is our very system of government that we’re talking about and they should bloody well know better.

Look, I get that they’re trying to exploit what they see as low-hanging fruit with Sajjan, but along the way, they’ve been dangerously blurring the lines of civil-military relations by asserting that the troops want him gone (do they aside from a few cranks? Never mind that it’s not these soldiers’ call), and by referencing Sajjan’s actions in military terms rather than political ones. Trying to use the term “stolen valour” is also offensive, not only because it’s generally reserved for someone who dons a uniform or medals without having been in combat (which is not the case with Sajjan), but because they’re co-opting it from the military for political benefit. But now they’re trying to go against the fundamentals of Responsible Government to score what they hope will be a cheap win.

That Her Majesty’s Loyal Opposition is trying to burn the system to the ground to score a couple of points is a very serious problem, and one indicative of a party that is more focused on populist spin than they are in being principled. It’s  a disturbing pattern, and one that they should knock off before they go too far down this garden path.
