Roundup: Warning signs ignored by the RCMP

Monday morning was kicked off by a very good story over on Global about a lawsuit launched by former employees in the RCMP’s intelligence unit regarding the bullying of alleged spy Cameron Ortis, who awaits trial for allegedly stealing state secrets with the intent to sell them. The suit alleges that Ortis was bullying out anyone from his office that he didn’t like in order to install friends and people who would be pliant. While the government says they are going “look into” the matter – the fact that this was raised long before Ortis’ arrest and apparently ignored by the RCMP’s management is concerning.

Meanwhile, here’s former CSIS analyst Jessica Davis putting these allegations into perspective – and painting a worrying picture of our national security institutions in the process.

Roundup: The menace of ignorant premiers

Occasionally a politician will say something so blindingly wrong and stupid that it makes me incandescent with rage, and yesterday the honour went to PEI’s new premier, Dennis King, who believes that because he’s in a hung parliament that he’s “not the government,” but that “we’re all the government.”

And then my head exploded.

King is the premier, which means he’s the government. And for him to try and abrogate his responsibilities in the face of questions from the opposition is a sickening lack of civic literacy and frankly spine. Trying to shame the opposition into “collaborative government” is frankly trying to avoid accountability. After all, when everyone is accountable, then no one is accountable, and that’s not how our system works. He’s the premier. He is responsible to the legislature for the decisions that the government makes, and while he’s trying to launder them through the opposition in the name of “collaboration,” that’s not how the system works. It doesn’t matter if it’s a hung parliament – that only means that he needs to work harder to secure the support of the opposition, not that they are in government with him. And yes, I’m enraged by this because he and everybody else should know better.

Alberta extremism

On another topic, this story out of Edmonton about extremist billboards calling for civil war against the rest of Canada, and promoting conspiracy theorism and outright lies about Justin Trudeau is extremely concerning because this is how illiberal populism happens. And Jason Kenney has a direct hand of responsibility in this, both by selling lies about the province’s situation and about what Trudeau is and is not doing, and by selling them snake oil in a bid to keep them angry because that’s how he gets votes. But as the anger won’t dissipate now that he’s in charge, he’s forced to try and keep the anger going in one way or another and hope that it doesn’t blow up in his face – hence why he’s inventing new grievances by things like his sham Senate “elections” – because unless he keeps trying to point that anger to new enemies, it will turn on him. I really don’t think he appreciates the monster he’s created, and these billboards are a warning sign that needs to be heeded.

Roundup: Mandate letter madness

Yesterday was the big day that the mandate letters for the new cabinet minister were finally released, and the Cabinet committees got a bit shake-up. You can get an overview of the letters here, and some deeper analysis on what’s being asked of Jim Carr in international trade, Dominic LeBlanc in intergovernmental affairs, and Jonathan Wilkinson in fisheries. Reading through the letters, however, I found that almost all of the new letters – either with established ministries or with the new ones that they are establishing – were all giving them specific direction on which other ministers they should be working with to achieve specific goals. Very few of them were goals that they were to pursue on their own, which I find to be very curious from a governance perspective.

The big question mark remains around Bill Blair and just what he’s supposed to do as Minister of Looking Tough on Stuff – err, “border security and organized crime reduction.” We got no insight as to whether he has any actual operational control over a department or an agency like CBSA. Rather, his list of goals included looking at a ban on handguns and assault rifles as part of the existing Bill C-71, and that as part of his duties in relation to the border, he should have discussions with the Americans about the Safe Third Country agreement, but it was all rather vague. (There was also some talk about opioid smuggling as part of his border security duties, for what it’s worth). Nevertheless, it was another one of those letters that was focused on which other ministers he’s supposed to be working with as opposed to providing oversight of a ministry, which I find weird and a bit unsettling as to what this means for how the machinery of government works under Trudeau.

Meanwhile, the number of Cabinet committees was reduced, and some of the files that certain of these committees were overseeing got shuffled around. We’ll see how this affects governance, but it’s all a peek into the sausage-making of governance (which, it bears reminding, that the Ford government in Ontario refuses to give any insight into as he refuses to release his own ministers’ mandate letters).

Roundup: Giving succour to racists to own the libs

That heckler the PM had an encounter with late last week turned into a big Thing today as it was revealed that she was a member of far-right and anti-Islamic and anti-immigrant groups in Quebec, and that her heckles were a set-up that Trudeau walked into. Trudeau himself offered no apologies for his response, but wouldn’t you know it – the Conservatives have decided to go to bat for this woman.

No, seriously. “Asking a question about the budget.” That was not “asking a question about the budget.” The translation of her (shouted) question was “I want to know when you are going to refund the $146 million we paid for your illegal immigrants.” That’s not a polite policy difference about interprovincial politics, as so many other conservatives have tried to intimate, that her question was the same one asked by three different provincial governments. It was followed up by her asking if Trudeau was tolerant of “Québécois de souche,” which some people translate as “old stock Quebeckers,” but that lacks the racially-charged nuance of the phrase, which some have likened to the “Quebec-speak variant of Master Race.” Add her “question about the budget” to this racially-charged phrase shows that she’s not concerned about the budget – she believes that these asylum seekers are stealing from Quebec. But, you know, it was “a question about the budget.” But wait – it gets better.

Andrew Scheer decided to weigh in and, ignoring all of what happened and the context, and the woman’s racially-charged language, Scheer attacked Trudeau for “name-calling” and “demonizing” people who are critical of him. Trudeau calling an avowed racist, with a history of public racism, a racist, is apparently “a vile [personal] insult” because he’s afraid of “legitimate criticism.” So yeah – way to go for offering succor to racists and white nationalists to “own the libs.” And while this woman’s apologists go on about how Trudeau “inflamed the situation” rather than answering her question – as though it was asked in good faith (it wasn’t) and wasn’t going to be immediately followed up with her racist remarks (which it was inevitably, given that this was demonstrably a set-up), you have to wonder just how wilfully blind Scheer and company will be in order to try and make Trudeau out to be the real monster.

Meanwhile, John Ivison says that confrontations like these are political gold for Trudeau because he can run against the image of a xenophobic Conservative party, which plays well to a certain segment of the population, while Chris Selley says that Trudeau needs to be careful when calling out intolerance because of his party’s own obnoxious tendencies.

Roundup: Bozo eruptions coming from the top

Given some of the “bozo eruptions” over Twitter over the past couple of days by Conservative MPs and senators, I have to wonder about both the mindset behind this strategy of posting, and the adult supervision that underpins it. Obviously, the latter is lacking given what we’ve seen this week especially, but we also can’t deny that there is an attempt at strategy behind it, even if it’s a strategy that’s been kluged together in service of a narrative. That narrative is to put “Justin Trudeau” and “failed” in as many sentences together as possible, but it’s also about a deliberate campaign of lies and misdirection in service of creating that narrative. But even with this in mind, some of it is just really, really dumb.

Take this tweet from Shannon Stubbs – who is a pretty decent MP, it should be stated, but seems to have lost her ability to be credible over Twitter. Part of what is so gross about this tweet is that it basically undermines our entire criminal justice system, which requires that the accused have advocates in order to have a fair trial. And she knows this – the party knows this (while they go about fetishizing victims of crime and altering the entire vocabulary around them in order to tilt the playing field against the accused so as to deny them fairness). But the temptation to be shamelessly partisan is just too much for some of them to withstand. And in the end, I have to think that it’s this mindless partisanship is often to blame – and it is mindless. It robs them of their intellect and critical thinking capacity, and makes them focus solely on scoring cheap points.

I’ve seen a lot of the chatter about the tweet from Senator Denise Batters about Omar Alghabra, to the point that the woke crowd is referring to as a “white nationalist,” which I’m quite sure she’s not – she’s just partisan to the point of being mindless, and that includes making ill-suited attacks to the point of dogwhistling, because it becomes reductive and about scoring points. She should know better. (As for Blaine Calkins and his tweet, well, I’m not sure I’d give him the benefit of the doubt that he knows better, so I’ll leave it at that). But there needs to be a recognition that this kind of point-scoring is actually doing damage to their own brand, and as we’ve seen this week, has blown up in their faces more than once. You would hope that this would be cause for some reflection and that they’ll think twice before continuing to engage in this kind of behaviour – but I’m not holding my breath. So long as the official line from the leader is to lie over Twitter as often as he thinks he can get away with it, he’s set a low bar of an example for the rest of his caucus to follow, and it’s no surprise that we’re seeing these kinds of bozo eruptions.

Roundup: Detailed spending or slush fund?

The Parliamentary Budget Officer weighed in yesterday on the government’s desire to create a $7 billion fund as part of the Estimates to get a jump start on budget promises before those spending plans can be finalized with departments and voted on in the Supplementary Estimates later in the year. The verdict? That enabling this would make it more difficult for MPs to do their duty of controlling government spending, because in their estimation, nothing obliges the government to spend that $7 billion on what is outlined in the budget annex. Government officials (on background) dispute this because they say that if they were to spend it on something other than what is laid out in the budget annex that it would constitute an unauthorized use of public funds.

“See! It’s a slush fund!” The Conservatives immediately cried and gave their little song and dance about how it’ll mean the Liberals can spend it willy-nilly on anything they want. And perhaps they should know – after all, they created a $3 billion “emergency fund” to deal with the 2008 financial crisis and wound up spending it on things like the gazebos in Tony Clement’s riding for the G8/G20 meeting when those funds were supposed to be used for border infrastructure. So is this the voice of experience talking? Good luck getting them to admit it. The NDP line, meanwhile, is that this is the Liberals trying to “suppress Parliament,” which I think you’ll have a hard time trying to find evidence for given how few actual strongarm tactics they’ve managed to engage in so far (a couple of ham-fisted moves that they’ve had to walk back from aside).

While on the one hand, I think the PBO has a point, on the other hand, it’s not a $7 billion black box, and the spending is outlined in the budget, and they can be held to account for it, which is also Parliament’s role. And given that the Estimates are basically unreadable currently and the fact that most MPs don’t pay the slightest bit of attention to them, the cynic in me wonders why they really care (other than it’s a convenient bludgeon to bash the government with). After all, I’ve watched enough times when the Commons has passed the Estimates at all stages with no actual debate or scrutiny on several occasions, leaving the actual hard work up to the Senate. Add to that, watching the Conservatives on their vote-a-thon vote against line items in the Estimates that they probably shouldn’t have shows how little attention they actually pay to the process and the contents. So would this $7 billion fund matter in the long run? Probably not. If nothing else, it’s more impetus for why we need to fix the Estimates process, to realign it with the budget and the Public Accounts, and ensure that they’re readable once again. And until that happens, I find myself having a hard time caring about this item given that there has been an attempt at due diligence that is otherwise so often lacking.

Roundup: Morneau cleared – mostly

On her way out the door, now-former Ethics Commissioner Mary Dawson released a statement saying that there was no ethics issue or conflicts of interest with Bill Morneau’s share sales, which blows the hysterical arguments about “insider trading” out of the water. As well they should be – these claims were never serious to begin with, and were part of the attempt to throw everything at the wall in the hopes that something, anything, would stick. This of course leaves the “investigation” into Morneau introducing Bill C-27 on pension reform while he still indirectly held those Morneau Shepell shares, and the opposition are still waving their hands around this and trying to insist that this is some kind of Major Ethical Issue, never mind that the allegations themselves depend on a fundamental misunderstanding with how ministers sponsor bills, and ignoring the fact that clearing bills with the Ethics Commissioner before they are tabled would be a violation of cabinet confidence and parliamentary privilege. But hey, we’ve already established that we don’t need plausibility or facts to get in the way of laying allegations – it’s simply about trying to build a “narrative” by whatever means necessary.

Meanwhile in Maclean’s, Paul Wells has a lengthy interview with Morneau about how his last six months have gone, and it’s a good read. The major takeaway in all of this is that Morneau and the cabinet got complacent after a string of successes, where they managed to get some pretty big wins despite initial grumbles from provinces around things CPP reform or healthcare premiums. The fact that they shopped those planned changes to private corporation tax rules several times and got no pushback meant that they let their guards down, and then with a combination of misrepresentation around what those changes were, and reporting that didn’t question those narratives, Morneau wound up blindsided, which was compounded by his dislike of being scrappy enough to respond to allegations and mistruths forcefully. One hopes that he’ll have learned his political lessons and that he’ll start stepping up a little sooner – and communicating better – but time will tell.

Roundup: Shadow ministers vs critics

Conservative leader Andrew Scheer is set to release his full critic list today, not only to be dubbed as a shadow cabinet, but with plans to style the critics as “shadow ministers.” Now, this is normally the kinds of British/Westminster nomenclature that makes me feel all warm and fuzzy inside, which is why I suspect that a fanboy like Scheer is doing it, but I would raise a particular note of caution – that unless Scheer plans to actually have his “shadow minsters” act in the way that Westminster shadow ministers actually operate, then it’s going to quickly come across as a twee affectation.

So what kinds of differences would matter between a British shadow minister and a Canadian critic? For one, it’s a far more institutionalised role, where a shadow minister plays the function of someone who is able to fill the cabinet role immediately if the government were to fall, rather than the kinds of placeholders that we’ve come to expect in Canadian critic roles. Shadow ministers, in my observation, tend to be in place for a fairly long time and develop expertise in the portfolio, and they have more structured time to visit the departments and get briefings from civil servants, which doesn’t seem to be the way that Canadian critics operate (who do get some briefings, but in my estimation, are not to the same level). Of course, one of the reasons why is that cabinet construction in the UK doesn’t have to deal with the same regional considerations that Canada does, so it’s far easier to have someone who was in a shadow cabinet position slide into cabinet, whereas in Canada, the federalist calculations may not work out.

Another key difference is that UK shadow ministers are not members of select committees, whereas in Canada, critics are leads for their party on standing committees. Why this is different is because in the UK, it not only lets the shadow minister spend more time with their portfolio, but it gives the committee members more independence because they don’t have the lead on the file shepherding them. Just by numbers alone, I’m guessing that this isn’t going to happen here (another advantage to the UK’s House of Commons having 650 members instead of 338). One could also remark that the current Conservative Party in Canada hasn’t demonstrated a great deal of willingness to give committees a great deal of independence (especially seeing as they turned them into branch plants of the ministers’ offices during the Harper years), but who knows? Maybe Scheer is more serious about it. But unless he wants to reform the way his critics operate, then I’m less sold on billing them as “shadow ministers.”

Roundup: A shuffle and a split

So, there was that relatively small cabinet shuffle yesterday, some of which was telegraphed in advance, some of which became the subject of wild speculation as Trudeau seemingly threw in a couple of red herrings for the pundits to go wildly chasing to no end (LeBlanc and Wilson-Raybould especially). In the end, the new faces are Seamus O’Regan at Veterans Affairs and Ginette Petitpas Taylor to Health, while Carla Qualtrough moves to Public Services and Procurement, Kent Hehr takes over sport and disabilities, and in the biggest move, Jane Philpott moves over to a split Indigenous Affairs portfolio, so that Carolyn Bennett now becomes minister of Crown-Indigenous Relations, and Philpott becomes minister of Indigenous Services. While it’s hard to say that Hehr’s move is anything but a demotion, O’Regan’s move is being noted both for his close friendship with Justin Trudeau, as well as his move from rehab to the cabinet table, for what it’s worth. Also of note is the fact that new mandate letters will be forthcoming in the next few weeks, while there was a bit of panic when the old ones were re-issued with new names for the time being.

The real news is the fact that Bennett and Philpott’s joint mandate will be to ultimately dismantle Indigenous and Northern Affairs and to create two separate departments that will move the files toward greater self-governance and be a less paternalistic structure for Indigenous communities to deal with – especially since the current structure does not currently suit the North well for Inuit communities, or Métis. Complaints about the creaky bureaucracy hampering the Indigenous file are constant, and structural reform like this is probably the next logical step in moving those particular files forward, but there are already detractors moaning that this will just mean double the bureaucracy and double the obfuscation. Maybe. I’m also dismayed by commentary from the likes of Hayden King who dismiss what the government has done to date as being symbolism and process. Why that bugs me is because process is important. Democracy is process. Changing the fundamental ways in which things happen – i.e. process – is important can’t just be shrugged off because it doesn’t turn into an instant fix. These kinds of issues are systemic and stubborn, and sometimes changing process to get the wheels turning is actual progress, even if it takes a while to see the results. None of this happens overnight – indeed, dismantling INAC won’t either, and step one is yet another consultation process on what the end goals are going to look like so that they can make the split with those in mind. And no doubt, we’ll hear yet more naysayers, but these are changes that will take time to happen.

AFN National Chief Perry Bellegarde is happy with the change as a next step to dismantling the Indian Act. Susan Delacourt sees Trudeau keeping his friends close in this shuffle, while Chantal Hébert notes that the Canada-US files remain untouched in the shuffle, which points to how Trudeau is targeted isolated problems while looking to stay the course with the NAFTA talks. Paul Wells looks at Jane Philpott as this government’s go-to fixer, while Aaron Wherry notes the two doctors now in charge of the Indigenous portfolios and what that may mean.

Roundup: That fictional “crippling tax hike”

This particular exchange dominated my Twitter Machine feed over the weekend. And lo, it’s some of the same tired, disingenuous rhetoric that over this same issue we’ve been talking about for weeks, because apparently, that’s how we roll.

Of course, the point is to be disingenuous and raise a panic so that they can fundraise and data mine over it with this petition that Rempel is pushing, which is a model of political engagement that we really, really need to stop doing in this country, but unfortunately, we’re in the “If it works…” line of thinking, never mind the broader consequences.

Erin O’Toole decided he wanted to get in on the action to complain that these changes would affect “competitiveness.”

Because you know, facts are hard. And hey, Kevin Milligan went through and modelled the impact that those tax changes will actually have, and shockingly, it’s not what the Conservatives are trying to insist will happen. Imagine that.
