Roundup: Yes, the Conservatives did it too

Amidst the faux drama in QP this week about the apparent discrepancy between the Dogwood Initiative getting funding for an anti-Kinder Morgan activist while the government refuses to give funding to groups that use such summer jobs grants to pay for students to distribute fliers of aborted foetuses, or to groups that refuse to hire LGBT students, I find myself losing patience with the constant refrains that if the Conservatives engaged in this kind of behaviour, there would be riots in the streets.

Reminder: the Conservatives did engage in that kind of behaviour. They wantonly defunded all manner of organizations, whether they ensured that women in developing countries could access safe abortions, whether they advocated for women’s equality here in Canada, or if they were ecumenical social justice organizations that engaged in education and outreach at home and abroad. They defunded the Court Challenges Programme which helped ensure that minority groups like the LGBT community could do the work of bringing their challenges to the Supreme Court of Canada (because it’s expensive and law firms can’t do it all pro bono). They cut funding to HIV and AIDS services organizations and diverted all manner of funding to a vaccine initiative that they then flaked out on and frittered away millions of dollars so that they had no impact (and the results of those cuts are still being felt today as the current government wants to shift funding priorities to prevention). They prioritized refugee resettlement for Christians in the Middle East over Muslims. They engaged in abusive auditing over charitable organizations that opposed them ideologically. All of this happened, in the most petty and mean-spirited manner at that, and there weren’t riots in the streets. There were a handful of protests, and the media barely mentioned a number of these cuts.

Is the way that the government handled this attestation on the Summer Jobs Grants heavy-handed? Yes. Was the wording clumsy? Probably. But groups aren’t being denied funding because they’re faith-based – they’re being denied funding because they’re refusing to either sign the attestation, or they’ve tried to rewrite it to suit themselves, despite the fact that the government has said repeatedly that “core mandate” refers not to values or beliefs, but daily activities. In all of the rhetoric and pearl-clutching, the actual facts are being distorted and need to be called back into focus. We also need to focus on the fact that the real problem here is that MPs get to sign off on those grants, which is a violation of their roles as guardians of the public purse, and instead makes them agents of the government in distributing spending (clouding their accountability role). But sweet Rhea, mother of Zeus, this constant invocation that “if the Conservatives did it…” is bogus and amnesiac. They did it. All the time.

Roundup: Propaganda and democratic interference

During a media availability yesterday, Justin Trudeau mentioned the Russian embassy’s propaganda efforts in linking Chrystia Freeland’s grandfather to Nazi publications in World War II as a reason for expelling diplomats that he accused of interfering in Canadian democracy. Almost immediately, we got some of the more obtuse pundits in our commentariat fretting about why we didn’t expel those diplomats at the time that happened, and why the government couldn’t just say that last week when they were asked how those Russians had interfered. And to clarify, Trudeau cited that as an example, which is very much interfering with our democratic processes. And as for why they didn’t expel them earlier, I direct you once again to Stephanie Carvin’s Open Canada piece about the expulsions, and why we allow intelligence officers to stay when we know that they’re engaging in espionage activities. Seriously – go read it.

And funnily enough, Carvin had pointed to that attempted Russian propagandizing days earlier when responding to Susan Delacourt’s column that wondered why we weren’t taking the allegations of Russian interference with more alarm that we have been. As Carvin points out – it’s not just cyber that we have to worry about, and if MPs were actually doing their jobs, they would be far more focused on this issue rather than re-litigating the Atwal Affair™ again and again to score cheap points.

Roundup: Promising a new framework

The big news yesterday was Justin Trudeau delivering a major policy speech in the House of Commons about creating a new legal framework for the rights of Indigenous peoples in Canada that aims to fully implement the treaties that have not been properly enacted, and that will build toward self-governance by creating the capacity within individual First Nations and other Indigenous communities that will enable them to take up that governance space at their own pace. Trudeau insisted that this would not require constitutional change but would rather put some meat on the bones of Section 35 of the Constitution, and the existing treaties. And yes, criminal justice reform including how juries are selected was also part of the promise (and I’ve heard that we might see new legislation around that in March). Trudeau said that this announcement comes with a new round of consultations, but the aim was to have legislation tabled by the fall, with the framework fully implemented before the next election.

Reaction from Indigenous leaders is cautious so far, because there aren’t a lot of details – and there probably won’t be many until something gets tabled later in the year. The flipside of that, of course, is that there’s room and space for these leaders to give their input during the consultative process that is to come, seeing as Trudeau is promising to work together to develop this framework. There are other questions when it comes to lands and resources, which I’m not sure if this framework itself will cover or if the framework will guide how those issues are to be solved going forward, and that’s also likely going to depend on the cooperation of the provincial governments, but there does seem to be some momentum. That will also depend on Parliament moving this forward, and while the NDP seem to be onboard, the Conservative response to Trudeau’s speech warned about being too ambitious, which should probably be some kind of a warning signal. But it’s early days, and we’ll see how the next few months unfold.

Roundup: Artificial deadline drama

It’s one of these kinds of stories that I’m already suspicious of – the kind that presuppose that the Senate is going to delay the course of legislation. And lo, the fact that there is a story with Bill Blair out there, shaking his finger at the Senate and warning them not to delay the marijuana legislation, is one that makes me roll my eyes because 1) the Bill still hasn’t passed the Commons, and may not yet for another week; and 2) I have heard zero plans from any senators that this is something that they intend to sit on until any deadlines pass or expire. In fact, I’ve heard pretty much the opposite – that to date, there is an extreme reluctance on the part of those making up the Independent Senators Group to delaying or being perceived to be delaying government bills, and they will provide the statistics to show that they pass bills faster than the House of Commons does as a way to prove that they don’t delay bills.

Oh, but what about the national anthem bill, which Conservative senators are sitting on and deliberately delaying? Well, that’s a private member’s bill, so it is at the mercy of Senate procedure, unlike a government bill – as the marijuana legislation is – which not only takes precedence over other business in the Senate, and which Senator Peter Harder, the Government Leader in the Senate – err, “government representative” could invoke time allocation on, and I’m sure that he would be able to get enough votes for it to pass (grumbling of Conservative senators aside). This having been said, I think that perhaps it may be pushing it for the government to insist that a major piece of legislation like the marijuana bill be passed by the Senate within three weeks given that they took much longer on it, and given that provincial governments have a lot to say on the matter – though I’m hearing that the Senate will likely sit a full week longer than the Commons will before they rise for the Christmas break, meaning that if the Commons passes it by this Friday, it would be four weeks for the Senate to pass it before the break, which is a long time for a bill in the Senate, but not unreasonable. And if the Commons was so concerned about how long it was taking, they would have picked up their own pace on the bill beforehand. They didn’t, and didn’t invoke time allocation on it thus far, meaning that this concern of Blair’s is artificial and used to create some faux drama. People aren’t stupid – creating a problem where one doesn’t exist is just as likely to backfire than it is to try and shame the Senate into doing your bidding.

Roundup: No maple death squads

A story that caught my eye yesterday was on the topic of foreign fighters who may return now that ISIS/Daesh has fallen. More particularly was the notion that the US, UK and France have all made it policy to try and target and kill their own home-grown fighters rather than risk them returning to their own countries. Canada, however, came out explicitly yesterday to state that we aren’t doing the same because we don’t engage in death squads. And yes, we’re taking the issue seriously, and our security forces are on alert, and so on. While it may be astonishing to hear, it’s also not unsurprising considering that this is a government that is committed to the Charter, and extrajudicial killings would seem to be a gross violation thereof.

The problem? Some of the responses.

While I have a great deal of respect for the good senator, I’m a bit troubled by the sentiments expressed because the implicit message is that governments should feel free to violate the Charter with impunity, with either extrajudicial killings, or processes that violate the Charter and our other international obligations against torture, as with the reference to Omar Khadr. And worse, the kinds of responses to that tweet are pretty disturbing in their own right.

Aside from the fact that any of these targeted killings would be outside of the rule of law, Stephanie Carvin also points out that this kind of policy would be a false certainty, particularly when it comes to verification. I would also add that it would seem to me that it keeps the focus elsewhere than on home soil, where radicalisation still happens to one extent or another, and I do think there is likely a sense that “Hey, we’ve killed them over there,” then we don’t think about how they were radicalised at home in the first place, and we don’t put in the time and resources toward solving that issue. Nevertheless, that our government follows the rule of law shouldn’t be a news story, but in this day and age, it would seem to be.

Roundup: No conflict to investigate

For all of the ink spilled and concerns trolled in Question Period, the Morneau-Shepell conspiracy theory is turning into a big fat zero for the Conservatives. Why? It seems that for all of the “appearance of conflict of interest” that they’re trying to drum up and selective laying out of facts in true conspiracy theory style (with the added cowardice of hiding behind the so-called “experts” who laid them out in committee testimony), the Conflict of Interest and Ethics Commissioner herself is shrugging it off.

“There does not appear to be reasonable grounds at this time for the Commissioner to launch an examination under the Conflict of Interest Act or an inquiry under the Conflict of Interest Code for Members of the House of Commons,” said the Commissioner’s spokesperson, and added that they won’t bother investigating investigate “if there is no specific information to suggest that a provision of the Act or the Code may have been contravened.”

And guess who isn’t putting up any specific information that would suggest an actual conflict of interest? The Conservatives. They’re still “gathering information,” which is cute, because why bother filing anything formally when you can make all manner of accusations and cast as much aspersion as possible under the protection of the privilege of the House of Commons, that will be reported uncritically? After all, this is “just politics,” and you can worry about the “appearance” of conflicts all you want on flimsy to no evidence, while facing no consequences whatsoever. It’s tiresome, but it’s the kind of sad drama that we seem to be subsisting on rather than substantive debate on the issues and the actual concerns that appeared around those tax proposals. Such is the sad state of affairs these days.

Roundup: Divisions of Power at the Council

With the Council of the Federation meeting today in Edmonton, they had a pre-meeting yesterday with some Indigenous leaders – others having opted not to join because they objected to it being “segregated” from broader Council meeting. While I can certainly see their point that they want to be full partners at the table, I have to wonder if this isn’t problematic considering some of the issues that the Council has to deal with – NAFTA renegotiations, inter-provincial trade, marijuana regulations – things that don’t really concern First Nations but that premiers need to hammer out. Two groups did meet – the Congress of Aboriginal Peoples (which generally deals with off-reserve and urban Indigenous Canadians) and the Native Women’s Association of Canada, citing successful talks, while the Assembly of First Nations, Inuit Tapiriit Kanatami, and Métis National Council stayed out of it.

While I’m sympathetic to these Indigenous groups’ desire to have full-fledged meetings with premiers, I’m not sure that the Council is the best place to do it, because they’re not an order of government so much as they’re sovereign organisations that have treaty relationships. While some of their concerns overlap, they don’t have the same constitutional division of powers as the provinces, so a meeting to work on those areas of governance can quickly be sidelined when meetings stay on the topics where areas do overlap with Indigenous groups, like health or child welfare, while issues like interprovincial trade or harmonizing regulations would get left at the sidelines as they’re not areas in which Indigenous governments have any particular constitutional stake. And yes, we need more formalized meetings between Indigenous leaders and premiers, I’m not sure that simply adding them to the Council achieves that, whereas having separate meetings – as was supposed to happen yesterday – would seem to be the ideal forum where they can focus on issues that concern them. Of course, I could be entirely wrong on this and missing something important, but right now, I’m struggling to see how the division of powers aligns in a meaningful way.

Oh, and BC won’t be at the Council table as NDP leader John Horgan is being sworn in as premier today, even though he could have scheduled that date earlier so that he could attend (seeing as this meeting has been planned for months).

Roundup: Clarity is not an appeal

With another court case involving First Nations children, you’d expect there to be a bunch of hue and cry, and there certainly has been, but I wonder how much of it is actually misplaced. In this case, the government is seeking clarity from the court on a couple of aspects of the Canadian Human Rights Tribunal decision on applying Jordan’s Principle, which is not an appeal. I’ve seen all manner of people, from reporters to advocates on Twitter railing that the government is appealing the decision. Asking for clarity is not an appeal.

If you actually read the story, they have legitimate concerns about the restrictions around case conferencing and on timelines in the decision, both of which seem to be pretty fair concerns to have given that both ministers are medical doctors and have expertise in what these issues mean. And I fail to see how getting clarity is trying to find a loophole to get out of the decision – it doesn’t track with either the promises, the investments made, or the fact that the whole file is more complex than many of the advocates would let on. You can’t simply pour money into a system that doesn’t have the capacity to absorb it and distribute it effectively, and you can’t just wave a magic wand into a jurisdictional minefield like this particular decision addresses and expect that everything will always have the best outcome by sheer force of willpower, especially when there are areas that are unclear to players involved.

The fact that I’ve been a justice reporter for the past couple of years means that I’ve been exposed to a lot of the sensitivities involved in complex cases, and this certainly qualifies, despite what certain advocates and opposition MPs would have one believe. Outrage that the government is going to court isn’t necessarily warranted, and most of the time, it’s been pretty disingenuous, whether it’s on this case, or in assessing the damages in the Sixties Scoop class action, where again advocates, opposition MPs, and even reporters characterized it as an appeal when it wasn’t an appeal – it was the next stage in a process where they needed to determine damages on a case-by-case basis rather than simply mailing out cheques. Not every time the government goes to court is nefarious, and people need to calm down because there is a lot of crying wolf going on that’s helping nobody, most especially the people who these decisions are supposed to benefit.

Roundup: Demanding ATIP perfection may be the enemy of the good

I find myself torn about the government announcement on new legislation to amend the Access to Information Act because on the whole, they made most of the changes that they promised to, but they failed to uphold one promise, which was to make the Act apply to the PMO and minister’s offices. And yes, We The Media let them know how displeased we were about it.

Part of the problem here is that like so many of their other election promises, it may have been a stupid one – kind of like their promise around electoral reform. Why? Because it was always going to be problematic to promise access to cabinet documents, and there’s a very good reason for that, because much of that information should remain private because it will otherwise damage the ability for there to be unfettered advice to ministers or between cabinet colleagues, and they need to have space to make these kinds of deliberations, otherwise the whole machinery of government starts to fall apart.

Like Philippe Lagassé says, the better discussion would have been to have specific proposals as to what falls under cabinet confidence. Currently the Information Commissioner has some determination around that, and with the changes in this bill, the onus will be reversed – the government will need to convince her (and if that fails, the courts) that information should remain secret, as opposed to her having to take the government to court to get that access. That’s significant.

There is a lot of good in these changes, but I fear that it will be lost amidst the grumbling that it didn’t go far enough. And let’s face it – sometimes We The Media are our own worst enemies when we use Access requests for cheap outrage stories rather than meaningful accountability, and then wonder why the government suddenly clamps down and turns to message control, and worst of all, nobody wants to talk about that problem. That may wind up making things worse for everyone in the end.

Roundup: The looming retirement of the Chief Justice

Chief Justice Beverley McLachlin announced yesterday that she would be retiring on December 15th, a few months in advance of her mandatory retirement date, in order to give the government enough time to find a suitable replacement. Why that date is significant is because it will be at the end of the Court’s fall sitting, letting her use the next six months that she is able to clear off the files from her desk and work on any outstanding judgments rather than depart mid-sitting and the organizational chaos that would follow.

The next steps are now an important consideration. The government will not only have to name a new Chief Justice, but a new judge from Western Canada (and likely BC given that’s where McLachlin was appointed from). And in order to keep gender balance on the court it will likely have to be a woman, and in accordance with this government’s push for diversity, it will likely be a person of colour, if not someone Indigenous (and let us not forget that said person must also be fluently bilingual, which is another self-imposed criteria that this government has made for itself). This may be easier to find in BC than it was in Atlantic Canada, mind you. And for Chief Justice? My money is on Justice Richard Wagner, whom I know many close the court have already tapped as being the successor if they had their druthers.

Of course, we’ll see if this government can get an appointment process back up and running within the six months. Experience has shown us that they seem to have difficulty with that, especially as there are still some sixty or so federally appointed judicial vacancies still remaining around the country, and a few of the Judicial Advisory Committees charged with finding candidates for said vacancies still not fully appointed either, which is a problem. Of course, they may be able to largely reconstitute the committee that oversaw the nomination of Justice Rowe, with Kim Campbell again in charge of the process, but I guess we’ll see how long that takes.
