Roundup: The phantom lobbying menace

You can already hear the grumblings over social media over the headline: “As senators become more independent, meetings with lobbyists hoping to take advantage tripled in 2016.” And immediately most people go “Ooh, lobbyists are bad, so this sounds like a terrible thing.” It’s not actually true, but it’s something we’re probably going to have to unpack a little better rather than cause some mass panic (once again) about how the newly “empowered” Senate is going to be the death knell for democracy in this country, or some other such nonsense.

For starters, not all lobbying is bad. With strict rules in this country around reporting and gifts, this isn’t like the free-for-all that we’ve seen in places like Washington, where lobbyists were meeting with Congressmen in the steam room of the Capitol Hill gym, or taking them on private plane rides and giving them holidays, or showing up on the floor of the House to watch them cast votes, all while funnelling money into their re-election campaigns. While I believe they tightened some of those rules down south, we simply don’t have that kind of lobbying culture here in Canada, so get that out of your minds first of all. Secondly, Senators in Canada don’t have re-election campaigns to finance, so the influence that lobbyists can try to gain with financial incentives of one variety or another are also non-existent here, so once again, don’t try to map an Americanism onto the process here. Third, lobbying is not all corporate influence. A lot of lobbyists represent charities or non-profits, so best to keep that in mind when you see the numbers grouped together.

Meanwhile, as for what they hope to achieve, well, remember that despite the newfound “independence” of the Senate, its powers are still fairly limited. Those hoping to use this newfound power to amend more bills or delay others will find that when it comes to any amendments, they would still need to be accepted by the House of Commons, and there has been very little acceptance so far of most amendments sent back by the Senate unless it’s a glaring error. And as for delays, if it’s a government bill there are tools like time allocation and closure to force them through the system. Just because Government Leader in the Senate – err, “government representative” – Senator Peter Harder hasn’t yet availed himself of those tools doesn’t mean he can’t or won’t. So really, your mileage with how effective lobbying efforts will be will certainly vary.

The uptick in lobbying is not unexpected now that the usual central channels for information flow have been disrupted. That’s to be expected, so this increase is hardly nefarious. I’m more concerned with cabinet ministers lobbying individual senators than I am actual lobbyists, to be honest, since those meetings are less open and transparent, and they have a lot more power to grant political favours. So really, let’s stay calm about this headline, but keep an eye on things nevertheless. Trudeau’s plans for a “more independent” Senate are certainly proving the rule around unintended consequences.

Roundup: A reasonable plea for restitution

Retired Senator Sharon Carstairs is looking to be reimbursed for some $80,000 in legal fees after being caught up in the Auditor General’s report on expenses, and it’s a tale that exposes how shabbily many senators were treated in the wake of that report. To recap, that AG report essentially made up a bunch of rules that did not exist, particularly around how many days a year constituted “primary residency,” which Carstairs got caught up in. And in a rush to show the public that they were taking this report seriously, the Senate turned over the report directly to the RCMP, and Carstairs was left trying to keep her reputation intact, hence retaining counsel and trying to explain that she hadn’t broken any rules.

What needs to be repeated again with this story is just how problematic that AG report was. When the Senate later retained its own counsel to go over that report to see if they should try to sue any of the senators who had refused to repay or seek arbitration for the identified sums (which included Carstairs), that legal review laid bare the arbitrary rules that the AG imposed as part of his review, and essentially how shoddily it was done. And I know several senators who simply opted to pay back the sum rather than keep fighting it because they wanted it to go away – Carstairs refused, and it looks like she’s going to be punished for it, whether financially with the loss (the maximum reimbursement for legal fees under Senate rules is generally $25,000), but also with the loss of reputation. I would hope that the Senate has had enough time since the audit that they can now revisit this case and offer the apology and what restitution they can, and admit that they were hasty in their actions because they were trying to appease a public that was baying for blood post-Duffy, for what good it did them. I would also hope that more of my media colleagues would also start calling out the AG for the problems in his report when cases like Carstairs’ come up again in the media, but I suspect that won’t happen, as we pay far too much deference to him as being untouchable and infallible, when clearly that’s not the case.

Roundup: Nomination shenanigans?

It looks like there are some shenanigans in Liberal nomination races for a couple of those upcoming by-elections, and as many a pundit has been saying today, Liberals gonna Liberal. And you can pretty much chalk this up to one more great big disappointment between the lofty Liberal rhetoric about valuing open nominations and then doing shady things like they have with the nominations in both Saint-Laurent and with Markham-Thornhill.

Part of what doesn’t make sense from an optics perspective is the sudden rush to call the last two by-elections for the two most recently vacated seats. In both Ottawa-Vanier and the two Calgary seats, there has been plenty of lead-time and nominations happened with nary a peep, but in the last two, the sudden rush has meant problems. With Markham-Thornhill, they retroactively cut off membership sales, which is presumed to help the “chosen” candidate, former PMO staffer Mary Ng. Ng’s campaign says they lost hundreds of registered members too, but again, this is about optics. Meanwhile in Saint-Laurent, a current Montreal borough mayor was declared not to have passed the green-light committee but they refuse to say why, which is seen as clearing the path for “star candidate” Yolande James (though there is still one other candidate, so it’s not an acclamation). But while they may have reasons for not greenlighting said borough mayor, the fact that they refuse to say why is again a nightmare for optics when this is supposed to be the party of openness, transparency and open and fair nominations.

Part of why this is such a disappointment is because we really need to push back from party leaders’ interference in nomination races if we want to restore the balance in our politics. That’s not to say that there shouldn’t be safety mechanisms in the event of hijacked nominations (because there absolutely should be), but those mechanisms shouldn’t be the leader’s office. A strong grassroots is essential in our system, and with every time that the leaders and their offices interfere (because they feel emboldened to thanks to the bastardized system of leadership selection that we’ve come to adopt and go full-bore on at every single opportunity), we choke off the most fecund part of our democracy. Shenanigans and the apparently hypocrisy of proclaiming open nominations while appearing to play favourites undermines the bottom-up practice of politics, and it’s something we as Canadians need to push back against in every party.

Roundup: A jobs crisis report rooted in fancy

The Conservatives released their Alberta Jobs Taskforce report yesterday – a make-work project to make it look like they were paying attention to the plight of the province’s resource-driven downturn, never mind that it wasn’t going to actually do anything because they’re not in government. The eleven recommendations that it came up with were…ambitious. I won’t say magic (such as the Ontario NDP’s Hydro plan, also released yesterday, relied on), but I will say that it relies a lot on wishing and hoping instead.

To start off with, the top recommendation is to eliminate the proposed carbon tax – which is provincial jurisdiction, not federal, to be clear – and to reduce corporate and small business taxes along with reversing CPP contribution increases. These are typical Conservative bugaboos, so it’s not a surprise we would see these recommendations. “Reducing red tape” for resource projects? It’s like the Conservatives forgot that when they tried to do that when they were in office, it backfired on them and created even bigger headaches as the lack of due diligence, particularly around dealing with First Nations, landed them in court numerous times. Encourage retraining? Provincial jurisdiction. Review EI to “improve efficiency”? You mean like their ham-fisted attempt at doing that a couple of years ago that cost them every Atlantic Canadian seat that they had? Recommendation five is particularly interesting because it calls on both a) reducing red tape for starting small businesses while b) creating tax credits to hire unskilled workers. Ask any small business and they’ll tell you the worst red tape is the complex tax code, so asking for the creation of yet more tax credits is to work against the first demand. Coherence! Implement programs to encourage hiring of recent graduates (sounds like big government), while increasing financial literacy across Canada? Erm, how does that actually help youth? I don’t get the connection. Lower interprovincial trade barriers? Well, considering that every government has tried doing that since 1867, and that the Conservatives didn’t make any tangible progress in their nine years in office, I’m not sure that Alberta hurting now is going to suddenly fixate everyone to solve that problem. Adjust domestic policy to the new Trumpocalypse reality? Seriously? There is no policy coherence coming from the States, so how can Canada “adjust” to it? Reform credentials-matching for new immigrants and the Temporary Foreign Workers Programme? Again, if it were easy, the Conservatives would have done it when they were in power. And finally, balance the budget? How does this solve Alberta’s job woes? Oh wait, it doesn’t. It’s just yet another Conservative bugaboo that they’re trying to hit the government with, using Alberta’s jobs crisis as the cudgel.

I’m sure that they spent time on this, but honestly, I’m less than impressed with the suite of recommendations. The lack of coherence and insistence that nigh-intractable problems should be solved now when they haven’t been for decades is more than fanciful.

Roundup: Manning and the Populists

It’s the Manning Centre conference here in Ottawa, which is the “conservative Woodstock,” as they say, and is pretty much were all of the small-c conservatives come to network, only this year, in the midst of the Trumpocalypse happening south of the border, the flavour of this year’s conference has changed, with much more pandering to the fringe elements, catering to overblown fears of Islamic terrorism and the kinds of populist demagoguery that are suddenly in vogue. Oh, and all fourteen Conservative leadership candidates are also there, and hey, they had a little debate, which allowed them a bit more freedom to actually debate in small groups, but most of it was still their canned talking points, so take it for what it’s worth.

As for conference programming, here’s Kady O’Malley’s recap of the first half including Preston Manning’s speech, and her assessment that fears of a Trumpist takeover appear to be more overblown, as many of the demagogic panels have had less than spectacular attendance. John Geddes recaps the moments of the leadership debate that had the biggest sparks. Geddes also has a conversation with Manning about populism and how it’s shaping debates right now.

Andrew Coyne warns Conservatives at the Manning Conference about the siren song of populist demagoguery. Chris Selley looks at that demagoguery up close in the panel on the “Islamist extremist menace” at the Conference, calling it bonkers. John Ivison looks at the dynamic Kevin O’Leary is bringing to the Conference and the race, and the outsized role he is starting to play, building an “Anyone but O’Leary” vibe. Paul Wells notes the changes in the Conference’s tenor over the years as a result of the political culture of followership, eager to imitate the perceived leaders of their pack.

Roundup: M-103’s ongoing morass

Some of the nonsense around M-103 and the Conservatives’ competing supply day motion that “all lives matters” the Islamophobia debate, continues to churn, with the Peel Regional Police announcing that they have added patrols and additional protection to MP Iqra Khalid following the revelation of the level of threats and harassment that she’s received over tabling the motion – basically proving her own point about the problem of Islamophobia that needs to be addressed before we have a repeat of the Quebec City shooting. But adding to the morass is when one of her Liberal colleagues, Chandra Arya, said that what happened with the Quebec City shooting was a “direct result” of the kind of dog whistle politics that the Conservatives and the Parti Québécois have been engaging in, with talks of niqab bans and barbaric cultural practices tip lines. That, obviously, has yet more people up in arms over the whole debate – a debate which prompted a “protest” outside of a Toronto mosque yesterday where people demonstrated that they were totally concerned about the vague language of “Islamophobia” and were really concerned with free speech rights, as they held up signs calling for Muslims to be banned from Canada – once again, proving the whole point of M-103.

Roundup: Tough on the mentally ill

Yesterday, news came out that Vincent Li (now known as Will Baker) was given an absolute discharge; he of course was the man who beheaded someone on a Greyhound bus in 2008 while in the midst of a psychotic episode due to undiagnosed schizophrenia. He was later deemed not criminally responsible because, as stated, he was not in his right mind when the incident happened, and has since received treatment and is unlikely to reoffend. And predictably, social media lit up with outrage, particularly from the Conservatives who declared this an absolute travesty and an insult to the family of Li’s victim, Tim McLean, and how this “proved” that our justice system cared more about the rights of criminals than it did the victims. Rona Ambrose brought this up in QP a few days ago, when Li’s release was pending, and not once did she mention the fact that he was diagnosed with schizophrenia and was found not criminally responsible. (In his response, Justin Trudeau didn’t either, for the record).

But here’s the really galling part. Just days ago, Ambrose and many of these very same Conservatives were all over social media for #BellLetsTalk Day, talking about how important it is to take away the stigma of mental illness. And now here’s Li, who is as much a victim in this as McLean was because he was mentally ill, and the Conservatives are considering him to be an unrepentant murderer because of his mental illness.

So what is it? Are you serious about having adult conversations about mental illness, even when it’s inconvenient to your political agenda of being “tough on crime” (never mind that the courts established that he wasn’t criminally responsible because he was mentally ill)? Or are you going to insist that people who were mentally ill and have received treatment remain locked up in perpetuity, thus “proving” why people with mental illnesses should be stigmatized and marginalized from society? Because it’s one or the other. You’re all looking like a bunch of hypocrites right now, and like you were lying to the Canadian public when you wanted to #BellLetsTalk about mental illness.

Roundup: O’Leary’s debate debut

Saturday night was another Conservative leadership “debate,” and again I use the term loosely because there was very little debating going on. Yes, this particular event did offer more chances for rebuttal, but given that it was staged and structured like the most boring academic conference ever (all it was missing was a line-up at the floor mic for people to give fifteen minute speeches in the guise of asking questions to the panel), we still didn’t get a lot of candidates challenging one another. Not that it didn’t happen – it did, but most of the candidates spent their time taking shots at either Kevin O’Leary (particularly deriding him as not being a Conservative), and Maxime Bernier (most especially around his ideas about equalisation, which, to be fair, are a bit daft).

Going after Bernier may not seem like the think you would expect, but he has been leading the race in terms of fundraising, which is not an insignificant thing. One does have to wonder, however, if there are enough self-described libertarians in the Conservative Party to give him the edge he needed. Bernier, incidentally, says he was being attacked because his opponents are afraid of his position on equalisation. And to be fair, he’s probably right, but not for the reason he thinks, but rather because it has the potential to severely damage the party in the more “have not” provinces of the country, most especially in Atlantic Canada, where they already have zero seats.

As for O’Leary, this was his first real event on the campaign, and he didn’t exactly sparkle, but he did stand out from his competitors a few times, both when he refused to criticise the country’s justice system, pointing to his experience abroad, and in the kinds of shots he took at the current government, which were of a more brash tone than other candidates were taking. He also played his ethnic cards, saying he would consider it a personal failure if Lebanese Canadians didn’t all take out party memberships and declaring that he “owns the Irish vote.” Okay then. Will his brashness that help him? Maybe, considering how very milquetoast most of his competition has been, and the crowd who laps up this populist demagoguery seems to love people who “tell it like it is.” O’Leary, meanwhile, shrugged off the attacks and kept his cool, and didn’t take the bait and made a point of directing his attacks to Trudeau (and premiers Wynne and MacNeil) instead of his fellow candidates.

And the rest? Lisa Raitt had her best night ever, possibly bolstered by the fact that it was a bit of a hometown crowd for her, and she seems to be making her working-class roots that much more of her narrative, but I’m still having a hard time seeing what kind of direction she proposes to lead the party in other than “I’m everything Trudeau is not.” Also, props for bringing up that Globe and Mail piece on “unfounded” sexual assault rates and challenging the government to do something about it. Brad Trost and Pierre Lemieux were laughable, Chris Alexander seemed to be doing a lot of “me too” to the points of other candidates – most especially Raitt – but had nothing really new to say. Andrew Scheer made a point of being parochial, Michael Chong remains the grown-up at the table which probably dooms his campaign, and for as middle-of-the-road as he is, everyone was quoting Erin O’Toole’s big line of the night saying “We don’t beat the celebrity-in-chief with another celebrity-in-chief.” The problem is that nobody quoted the second half of his statement where he brought up Robert Stanfield as the model to follow. Remember Stanfield? Who never beat the celebrity PM of his day (being Pierre Elliott Trudeau) and who never became prime minister? Yeah, not sure that was the wisest analogy. Also, O’Toole kept making Silence of the Lambs references, but completely wrong ones. He thought he was being funny by calling all 32 Atlantic Canadian Liberal MPs “lambs” who were “silent,” when Silence of the Lambs is about a cannibal and a serial killer. Not sure that was appropriate. Oh, and about eight or nine candidates need to drop out by oh, yesterday, because at this point, they’re going to start doing more damage than good.

Roundup: The measure of a political promise

There’s been a lot of hay made, ink spilled and electrons converted into pixels over the last 36 hours or so about the value of political promises, and how terrible it is when politicians break them. It makes people so cynical, and it’s no wonder that people hate politicians, and so on. We had Liberal MPs Nate Erskine-Smith and Adam Vaughan prostrating themselves about how sorry they are that the promise was broken, voter reform groups wailing about how terribly they’ve been betrayed, and columnists pontificated on broken promises (though do read Selley’s piece because he offers some great advice, not the least of which is telling PR advocates to tone down the crazy. Because seriously).

But in the midst of this, we had Conservative leadership candidates laying out a bunch of promises of what they would do if they a) won the leadership, and b) won the next general election, and some of those promises were hilariously terrible. For example, Maxime Bernier thinks it’s cool to freeze equalization payments so that the federal government can tell provinces how they should be managing their own fiscal houses, or Andrew Scheer saying that he would enshrine property rights by using a novel approach to amending the constitution through the back door, as though the Supreme Court of Canada would actually let that pass.

And while everyone was tearing their hair out over Trudeau’s “betrayal” and “lies,” what were these two other, equally implausible promises as Trudeau’s on electoral reform, met with? A few pundits tweeted “good luck with that” to Scheer. And that was about it. So forgive me while I try to calibrate my outrage meter on political promises here, as to which ones we should take seriously and which ones we know are bad or wholly improbable but can safely laugh off.

To be clear – I’m not looking to give Trudeau a free pass on this one, and I’ve written elsewhere that I think he needs to own up to the fact that it was a bad promise made when he was a third-place party who were blue-skying a number of things. And I think that it should give parties and candidates pause so as to caution them against being overly ambitious in what they promise (preferably, though, without draining all ambition out of politics). But come on. Let’s have a sense of proportion to what just happened here.

Roundup: Smothering Rosemary’s Baby

In case you missed the news, and all of the howling earlier in the day, Justin Trudeau confirmed in a new mandate letter to Karina Gould that electoral reform is now a dead letter. And thank all of the gods on Olympus that they’ve smothered this Rosemary’s Baby because it was a stupid promise that he never should have made in the first place. I argue that much in a column for Loonie Politics, and it had the very real danger of undermining Trudeau’s ability to get anything else done for the next three years.

While people have wondered why Trudeau didn’t just promise to put this off until the next election, I think that would have been a worse outcome, and the issue would have grown like a cancer that would undermine the perception of that election’s legitimacy, as the demands of each party on that file continued to consume more and more time and oxygen. A swift death was better. Others have wondered how Trudeau could have declared there to be no consensus when he didn’t actually ask which system people preferred, but that misses a few key points. For one, there were some clear messages from the committee and from the MyDemocracy survey, some of which were that people didn’t want MPs elected off of lists (which severely limited the kinds of systems available) and that some of the systems out there would not have been constitutionally valid. Meanwhile, when the government did ask about outcomes (through the MyDemocracy survey), that was more informative than asking which system people preferred because people tend to think of electoral systems like they do wanting a pony, when they also need to be asked if they want to spend their time mucking out the stables. I’m sure you’d find that the answers would change right there. There have been accusations that Trudeau didn’t show leadership by not trying to forge some kind of consensus, but I’m pretty sure that would have been impossible. He had a preferred system that the opposition parties didn’t like and maligned for completely false reasons, and no matter what he did, it would have been viewed from the lens of self-interest and dismissed. In other words, it was a no-win scenario.

And then there’s Nathan Cullen, with his angry words and his big show of pretending that he wasn’t trying to be cynical about the process when Cullen’s whole modus operandi the entire time has been fuelled by cynicism. His manipulation of the formation of the special committee was a cynical con job wrapped up in moral outrage. His selective reading of the committee’s report, as well as the MyDemocracy survey, was self-serving to the extreme. But he presents an earnest face to the media, and people buy it. I get it. That doesn’t mean that he hasn’t been cynically playing this whole affair, because rest assured, he has been.

And now the myriad of hot takes. Chantal Hébert calls the promise a cheap electoral prop, which she’s not wrong about. Andrew Coyne goes for the full sarcasm in blaming voters for believing Trudeau’s promise. Tasha Kheiriddin says that Trudeau will wear this failure (though I suspect that only a small percentage of Liberal voters will actually care by 2019). Jonathan Kay takes the correct (in my opinion) take in that reform was never going to happen because our system doesn’t need to be fixed. John Geddes doesn’t think that Trudeau lied – just that the impetus waned as people were no longer discontent with a system that didn’t give them a Harper government (and I suspect he is also right). John Ivison agrees that Trudeau hasn’t demonstrated the level of mendacity for this to have been a lie from the start, but those who sincerely believed him will feel betrayed. Chris Selley goes a bit darker, and pre-emptively counted this as the kind of broken promise that makes people cynical about politics and gives rise to the likes of Rob Ford or Donald Trump. And he’s got a point, but honestly? Politics is what makes people cynical about politics.
