Roundup: Leitch keeps digging

So many hot takes on Kellie Leitch and her need to keep digging when it comes to her “Canadian values” test proposal. Leitch continued to insist that this is a topic worthy of discussion, and proposed yet more “Canadian values” to back up her claim, and this time, those values include “equality of opportunity, hard work, generosity, freedom and tolerance,” with a focus especially on the tolerance part. She also denies that this targets Muslims in any way and doesn’t think that characterisation is fair. So there’s that. Oh, and you can add Deepak Obhrai to the list of leadership candidates opposing Leitch’s position, and Maxime Bernier gave a somewhat muddled response that he believes there are Canadian values but you just can’t test for them.

In terms of pundit reaction, Michael Den Tandt seems to think that Leitch is going nativist for the sake of deepening her fundraising coffers, while Matt Gurney sees Leitch’s proposal as unworkable, but not really offensive per se. Susan Delacourt sees problems for Leitch from the perspective of a party that doesn’t seem to want to embrace a young female leader, though she may have tapped into an anti-immigrant sentiment within the ranks, while Madeline Ashby looks at the inherent contradictions in Leitch’s position. My own Loonie Politics column on Leitch’s campaign looks at the ways in which she and some of her fellow campaigners are picking and choosing which intolerances to run on, and her own tone-deafness about it (which, given today’s added comments, seem to really fit the bill).

In other Conservative leadership news, Brad Trost thinks that he can unite the party around his economic ideas while still running as a social conservative, and Deepak Obhari has filed his papers and is officially in the race.

Roundup: Not a grown-up party

There is an interesting piece in yesterday’s Hill Times about the policy process of the Green Party as it struggles to grow from an activist movement into a serious political party. Despite the heavy reliance on commentary from the one non-party voice in particular, there are some interesting lessons therein about ways in which their current process is causing problems with resolutions around things like the BDS movement, which put it at odds with the leader. If you recall during the last election, it came to light that some of their platform policies around things like divorce laws were MRA propaganda, forcing them to do quick disavowals to go along with the shrugs of “hey, we’re a very open party” and “grassroots democracy!” And don’t get me wrong – grassroots engagement is a good and necessary thing in politics, but there does need to be framework around it that ensures that grown-ups are in charge and that really problematic contributions can be weeded out rather than thrown into the “open-chalkboard” approach that sets too low of a threshold for some of the more odious policy ideas to make it through without a really proper vetting. (Conversely, there needs to be enough power at the grassroots level so it’s not just the leader’s office deciding policy without any accountability for doing so, which the Liberals seem to be moving toward). What’s more concerning is that the attempts to move to some form of a proportional representation system that would allow for these more fringe views to gain seats without the party having matured into a credible political force that can deal with its crazies. Believe it or not, there is such a thing as being too open and too “grassroots” in politics, and it’s part of what is causing the implosion of the Republicans in the States, where the lack of controls in favour of more “direct democracy” primaries – alongside with this narrative that government is corrupt or illegitimate – has caused it to become completely unhinged. Some of these same messages are being echoed by the kinds of people within the Green Party, coded in language around the current electoral or party systems. It does become concerning, and it’s why these kinds of too-open endeavours start to make me nervous.

Roundup: Patterns on the witness list

The electoral reform committee returns next week, and so far I see a lot of proponents of proportional representation on the witness list, not that this surprises me in any way, as well as an academic proponent of a referendum on electoral reform – also not a surprise. So look forward to plenty of glowing recommendations about how electoral reform will solve all of our political ills.

In the meantime, if you’re looking for some background reading the Library of Parliament has some updated publications in store – one on the history and evolution of our electoral laws, and another that provides an overview of our current electoral system and those employed elsewhere. That one I found particularly lacking, especially in the language it used to describe the current First-Past-the-Post system, adopting wholesale the arguments about “disproportionate” seat counts (logical fallacy), the supposed advantages of “regional parties” or “regional strongholds” with no discussion of brokerage parties, and buying into the arguments about voter turnout without being critical about them (this is a broad problem across all western democracies no matter the electoral system). The rest was an overview of other electoral systems, examples of their use in other countries, the history of electoral reform initiatives in Canada, and some adjacent issues like mandatory voting, online voting (with zero mention about the concerns of the secrecy of the ballot), and lowering the voting age.

What was missing from this tepid report was any discussion on the impact of these electoral systems, such as government formation or accountability, which boggles my mind. It’s literally taking a piece of a complex ecosystem and treating it in isolation with no regard for how it will affect all other aspects of it, which is a huge part of the electoral reform discussion. What kind of government you get after you vote in that system is kind of a big deal. And even bigger deal is how you get rid of that government in a subsequent election, which is not easy to do in most systems other than FPTP because the tendency is for a big central party to just shuffle around their coalition partners, and that can be an even bigger headache, delivering policies that only a tiny fraction of the population voted for. You’d think this would be relevant to an examination of electoral reform proposals, but apparently not according to the analysts at the Library. You’ll excuse me if my faith in this government’s process has just sunk even lower.

Roundup: The Brexit fallout

So, Brexit. If you missed how it all went down, here’s the recap of the evening’s events, a look at the Article 50 of the Lisbon Treaty regarding an exit from the EU, a look at other countries who may be next, and speculation about how the Queen is faring in the face of this result. There’s a look at the divisions within the UK, and what psychology tells us about feelings toward immigration and how that influenced the referendum vote. And of course, what the Brexit could mean for the Canada-EU trade agreement, seeing as the UK was one of the driving forces behind this agreement. The results of that referendum seem to have made Quebec sovereigntists chippy about the 50-percent-plus-one threshold, while Jason Kenney’s tweets once the results were announced raised a number of eyebrows. The Prime Minister, however, assures us that our economy is strong enough to be able to withstand the market storms triggered by this event. And then there’s the reaction. Doug Saunders notes that this is the first time that a far-right movement and its xenophobia has won a majority vote in a Western Nation, while Scott Gilmore notes that the Brexit could take a multitude of different forms. Andrew Coyne takes the events as a cautionary tale of countries engaging in self-harm. Paul Wells writes about the case that the EU needs to make for itself in the face of referenda like these, while Andrew MacDougall notes that this referendum, along with the Trump phenomenon in the states, is showing the power of demagoguery over fact and expert advice, which is probably the scariest part of this whole sad and sordid affair.

Roundup: Duffy expenses redux

Because it’s never over, the saga of Mike Duffy’s illegitimate expenses are back in the news as Senate Administration is demanding that he repay some $16,955 in expenses claimed improperly that were paid for using his third-party contract with Gerald Donohue. And, wouldn’t you know it, Duffy’s lawyer is raising a huge fuss saying that the judge in the trial already declared that these were okay – something senators dispute, saying that just because they were not deemed criminal it doesn’t mean that they were okay, particularly when these expenses were not allowable and that the third-party contract was used to go around the approval process. (Duffy’s lawyer, incidentally, is also hinting that they will demand back pay for the suspension, to the tune of $155,000). But this is where the particular nature of the Senate comes into play, which is that it’s a self-governing body that is protected by parliamentary privilege, and it needs to be in order to safeguard our democratic system. In governing its own affairs, it is allowed to enforce its own rules (which, it bears reminding, do and did exist no matter what Bayne tried to argue in trial). And it is also empowered to enforce its own discipline, which is what the suspensions were related to – not a determination of criminality or a reflection of it, but rather that Duffy (and Wallin and Brazeau) had brought disrepute onto the Chamber and an example needed to be made. Is it fair? Possibly not, but this is also politics. Bayne raised the straw man argument that the 29 other senators whose expenses were flagged by the Auditor General weren’t suspended, which is a ridiculous argument considering that a) Duffy was not part of that process at all; and b) they ensured that there was a resolution process that ended in repayment one way or the other, so nobody was seen to be escaping justice. I don’t think Bayne will find much truck in the courts if he wants to press the issue around Duffy’s suspension or the fact that they are demanding repayment for expenses that clearly were not allowed, but it seems that we may be subjected to more drama around this, possibly for years if they take the matter as far as the Supreme Court of Canada.

QP: A (mostly) serious, grown-up day

There we no major leaders present for Question Period yet again, and with an increasing number of empty desks, the time of year is getting increasingly obvious. After an emotional tribute by Nathan Cullen to UK MP Jo Cox, who was murdered in her home riding earlier today, there was a moment of silence in the Commons. Jason Kenney started off, demanding that ISIS be considered a genocide. Stéphane Dion assured him that because of the UN report on genocidal activities, they were asking the UN Security Council to make a declaration. Kenney insisted that Dion was late to the party and named off other affected local populations, and Dion reminded him that Canada’s policy was the same as our allies and we were taking the lead in getting the Security Council to Act and it was why we tripled our contribution to the allied forces in the region. A third round from Kenney got the same answer. Michelle Rempel was up next, and demanded action on resettling Yazidis to Canada. John McCallum noted that several families were on the way to Winnipeg in a few weeks under private sponsorship, and noted that the Immigration Committee had just adopted a motion to study it. Rempel quoted the act that lets McCallum take action immediately, and he reminded her that the situation was more complicated than that. Marjolaine Boutin-Sweet led off for the NDP, demanding parliamentary oversight for weapons exports. Dion stated that he controls export permits and does so with rigour and transparency. Boutin-Sweet then demanded a public inquiry into Afghan detainees, and John McKay listed off past and ongoing investigations. Murray Rankin was up next, and demanded that parliament pass Bill C-14 as amended. Jody Wilson-Raybould insisted that the bill as tabled was already constitutional and that it was the right approach. Rankin demanded the bill be referred to the Supreme Court, but Wilson-Raybould was not moved.

QP: Applauding and chiding Sweden

Despite it being caucus day, none of the major leaders were present in the Commons today, and I find myself at a loss as to why that would be the case. That left Denis Lebel to lead off, wondering if an announcement on softwood lumber was waiting for President Obama’s visit. David Lametti responded with the usual assurances that they are working hard on the file. After another round of the same, Jason Kenney stood up to attempt to shame the government over their decision to vote against their motion on declaring ISIS a genocide. Stéphane Dion noted that Sweden’s parliament defeated a similar irresponsible motion. Kenney tried again, and third time, but Dion wouldn’t bite, instead reading what a responsible motion would look like. Peter Julian led off for the NDP, decrying the delay in the court case between KPMG and the CRA — not that it’s actually the administrative responsibility of the government. Diane Lebouthillier noted that sometimes there are delays in getting evidence, and stated that the CRA is closing in on tax cheats. Julian asked again in English, got the same answer, and then Hélène Laverdière asked about a report on Afghan detainees, demanding a public inquiry. Harjit Sajjan responded that they take human rights seriously, and they would take any new allegations seriously. Laverdière demanded a public inquiry, but Sajjan wouldn’t bite.

Roundup: Two bills heading back

It looks like the Senate has nearly finished with two of the contentious bills on its plate, and both are headed back to the Commons with amendments. The first is the obvious one, Bill C-14, where the biggest change has been to drop the requirement that a condition must essentially be terminal for the law to grant a medically-assisted death, but other amendments such as allowing for advanced directives failed in part because Senator Murray Sinclair made a compelling case that the language in the amendment was sufficiently unclear. The challenge there is that while the government promises further study in the language of the bill, there is little guarantee that will actually happen, or if it does, that legislation will follow, because MPs are terribly spineless about these sorts of things and they require being “forced” by the courts.

The other bill is C-7, the RCMP unionization bill, where the list of exclusions that the government had put into the bill has been removed, and somewhat inexplicably, a provision that a union certification vote has to be done by secret ballot was inserted (though I suspect the latter was a compromise with the Conservatives to get them to pass the more important amendment of striking down the exclusions). In that case, the government has a hard time justifying those exclusions, particularly as they both make little sense, and perpetuate the problems of the Commissioner’s office already having too much power, while it would continue to give him even more.

So what’s next? Once those bills head back to the Commons, we’ll see how much the government plans to dig in its heels, and how tough senators can talk about insisting that those changes be in the bills, particularly as they have the weight of the Supreme Court of Canada behind them in both cases. The biggest problem the Senate will face is splintering resolve – enough senators are not willing to stand up to the elected Commons even in the face of a bill that is likely not to pass constitutional muster because the Commons is the elected chamber. Never mind that the Senate was created as an appointed body so that it could do just that – stand up to the elected chamber when need be, because their lack of a need for re-election allowed their reflection on bills to be more “sober,” and this is a case where that particular “sobriety” is needed in the face of pressure from religious and disability groups. But, as I maintain, it remains likely that the Commons is looking for an excuse to be “forced” to accept these changes, and the Senate threatening to use their veto would be excuse enough for MPs to make the needed changes in a way that allows them to hide behind the Senate and skirt responsibility, as they did the courts before them. We’ll have to see.

QP: Politicizing genocide

The benches were nearly full, and all of the leaders were present for today’s exercise in accountability. Rona Ambrose, mini-lectern on neighbouring desk, led off by demanding that the government was “shameful” in not declaring ISIS to be a genocide. Justin Trudeau strongly condemned the actions of ISIS, praised our efforts, and noted that they asked the international authorities to weigh on rather than politicians. Ambrose pressed, Trudeau reiterated that they wouldn’t trivialise the word “genocide” by using it inappropriately. Ambrose tried again in French, and Trudeau repeated his point about not making petty points with this determination. Ambrose moved to the plight of Yazidi girls and asking for them to be brought to Canada. Trudeau noted that they use the UN determination of most needy. Ambrose insisted that they weren’t refugees but displaced people, and the Conservatives hollered as Trudeau noted that the previous government diminished the capacity to bring people to Canada. Thomas Mulcair was up next, and lamented the court battle from a veterans group, and Trudeau insisted that they were making changes to help veterans. After another round in French, Mulcair moved onto marijuana decriminalisation, and Trudeau reminded him that decriminalisation won’t stop street gangs. Mulcair repeated the question in English, and got the same answer.

QP: A moment for Orlando

Things got off today with a few statements of condolence and shock around the attack on a gay nightclub in Orlando over the weekend, and a moment of silence in the House of Commons. Neither Rona Ambrose nor Justin Trudeau were present today, Trudeau meeting with the chief and youth delegates from Attawapiskat.

Denis Lebel led off by asking about the terror attack in Orlando and the execution of hostage Robert Hall in the Philippines. Ralph Goodale responded with condolences and assurances that there were no threats to Canadians. Lebel then demanded an electoral reform referendum, to which Maryam Monsef called on all parliamentarians to help the committee do their work. Lebel pivoted again, and asked about a carbon tax. Jonathan Wilkinson assured him that they were focused on growing the economy in an environmentally sustainable way. Andrew Scheer took a crack at that question in English, terming a carbon price an “Ottawa knows best” approach, and Wilkinson gave the same answer. Scheer then accused the Liberals of charging admission for an electoral reform town hall, and Monsef said that they all members were supposed to follow the rules around these town halls. Thomas Mulcair was up next, and raised their opposition day motion topic of marijuana decriminalisation for simple possession. Jody Wilson-Raybould noted that they can’t just decriminalise without ensuring that children could not access it. Mulcair gave it another go in English, got the same same answer, and then he pivoted to take on the scourge of bank fees. François-Philippe Champagne reminded him that the government doesn’t regulate the day-to-day operations of banks. Mulcair asked again in French, and got much the same answer.
