Roundup: O’Toole on the third ballot

On a third ballot result, Erin O’Toole won the Conservative leadership race. The big event turned into a very big disaster. It was delayed by over six hours because the machine they were using to open the envelopes with ballots started destroying thousands of ballots, and it was well past midnight by the time the first ballot was even announced – far beyond the day’s news cycle and past the deadlines for newspapers’ first editions, which had long since gone to print. While we were waiting, Andrew Scheer gave his farewell speech, which was bitter, and full of jejune understandings of conservatism or the political landscape – he railed against imaginary left-wing straw men, scared up a Bolshevik threat, lied about the media – to the point where he called The Post Millennial and True North (aka Rebel Lite™) as “objective” that more people should pay attention to, which is incredible.

As for the result, this was very much about the social conservatives flexing their muscles within the party. Both Leslyn Lewis and Derek Sloan got over 35% of the votes combined on the first ballot, and there were places where either of the front-runners came in third to Lewis, and she swept Saskatchewan, where MacKay came in last. And true to form, it was those social conservatives’ down-ballot support that played kingmaker to O’Toole over MacKay, who was inexplicably considered the “last Progressive Conservative standing” (which doesn’t make sense because he was in no way a PC MP, especially if you look at his voting record). O’Toole at least has a seat, so that means he can get to work immediately, but we’ll see how many bruised feelings are in the caucus and party ranks given how the campaign played out, especially given that O’Toole hired a professional shitposter to run his campaign.

For his victory speech, O’Toole graciously thanked his competitors, and thanked the “patriotic Canadians” who made the victory happen. He paid special mention to Quebec, where he won the most votes, and made it clear that he was going to keep Sloan in the fold, in spite of some of his odious statements. O’Toole insisted that he was going to unite the party, before he took pot shots at Trudeau. He said they would be proposing a new “positive Conservative vision,” and that they would be ready for the next election, which could be as early as this fall. And then it was onto the doomsaying about the direction of the country under the Liberals, complete with the economic illiteracy that has marked the modern Conservative party. “The world still needs more Canada – it just needs less Justin Trudeau,” O’Toole said, before insisting that everyone has a home in the Conservative party.

We’ll delve into the entrails of the regional breakdowns of the race, and the particular mechanics of it and how that affected the results, but I will tell you right now that I have little patience for these takes about how this result means that the party’s power is shifting eastward – that’s hard to believe given the concentration of their votes, even though none of the leadership candidates came from there. And frankly, the notion that the party requires someone from Alberta to helm it keeps it blinkered, and insular. That’s not how you build the kind of national party that the country needs.

Roundup: Data-sharing and demanding models

For his morning presser, prime minister Justin Trudeau noted that he was planning a teleconference with the premiers that evening to talk about coordinating their efforts, and better data sharing. He also stated that they had received 1 million new N95 masks the night before, and that they were working to validate the 10 million other masts they got over the past several days and were distributing those to the provinces as well. He got more questions on modelling the pandemic, saying that it was still coming because the data wasn’t there yet, and said that those returning to Canada from abroad posted a “real risk” to the entire country if they didn’t follow the rules and immediately self-isolate.

During the ministerial briefing that followed, Patty Hajdu wouldn’t entertain questions on whether or not she trusted the data coming out of China, saying that they relied on WHO data, and dismissing some of those concerns as conspiracy theories, which had the pundit sphere in a tizzy the rest of the day. Mark Miller also said that they were considering requests from a couple of different First Nations about military field hospitals being set up in their regions, while more money for pandemic preparedness was flowing. Bill Morneau had a separate appearance before a teleconference of the Commons finance committee (which was a bit of a gong show), where he stated that they went with hard-and-fast rules for compensation that could mean that there are gaps in coverage because that was the fastest way to get compensation out the door. (Of course, he didn’t spell out the capacity challenges, which just leaves him vulnerable to more baseless criticism).

As for the debate over producing the modelling, we’re seeing some provinces promising to roll theirs out – Doug Ford promising it’ll be today – but I’m having a hard time trying to see what it’s going to do at this point that will be of any real help. I am very convinced that we don’t have enough good and consistent data right now (and there are several experts who say we don’t have enough to do proper modelling just yet), and if people want to see how bad it can get, just look at Italy or Spain. I also don’t trust in the capacity of the majority of my fellow journalists to interpret any of this modelling data anywhere near correctly, given that they have proven to be proudly innumerate already during this pandemic (and a good many of them can’t handle basic civic literacy when they cover politics), so I am largely convinced that they are demanding the models for the sake of easy narratives, such as a screaming headline about worst-case scenario death counts. (Seriously – I have been in this industry long enough to know that’s exactly what’s coming). And I also fail to see how it would offer any kind of reassurance to the public, especially as they can see the death counts in other countries as well as they could a headline about worst-case scenario modelling in Canada – add to that the additional confusion of the disputes over methodology that would follow. Models aren’t data, and according to one data analyst I know, no one will read the technical quotes associated with any released modelling, and it will serve as disaster porn – and she’s right. I mean, certain outlets who shall not be named relied on dial-a-quote outrage from certain familiar sources to bolster their case for demanding the numbers be released, in the face other outlets getting opinions from specialists who are saying it’s too soon to have good data on this. But maybe I’m just pessimistic.

Roundup: The crash and the cries for stimulus

It was a tough day on the markets yesterday as stock markets plunged at record levels over panic-selling because of COVID-19, and oil prices cratered while Saudi Arabia and Russia got into a pissing contest. Bill Morneau held a post-market-closing press conference to assure Canadians that there was fiscal room to deal with the situation, but he spoke in frustrating platitudes and generalities as he so often does (because this government is largely incapable of communicating their way out of a wet paper bag), but it needs to be acknowledged that his budget challenge has become a lot more complicated, particularly as the oil shock is going to impact federal revenues as well as Alberta’s. But seriously, the whole Conservative “spent the cupboard bare” narrative is bogus and economically illiterate, and they are actively spreading misinformation about it.

Around the same time, Jason Kenney held his own press conference, saying that all options were on the table for dealing with the downturn on the province’s economy – and then immediately ruled out a sales tax, which would stabilize the province’s revenues. Because that might make sense. Rachel Notley says that he should scrap the budget and re-do it, given that its assumptions are now proved to be useless, but other economists say it’s likely not worth it at this point, and it would be better to have a fiscal update in the near future.

And then come the demands for some kind of fiscal stimulus plan, but one of the things they’re pressing is that measures need to be timely. Maclean’s talks to four economists about what they think such a plan could look like for the best impact.

Roundup: Ministers inbound

The ongoing protests in support of those First Nations hereditary chiefs protesting the Coastal GasLink pipeline have not yet resulted in arrests, raids, or other police action to enforce the court injunctions just yet, and VIA Rail has shut down passenger rail service throughout the country, while CN Rail has shut down their eastern Canadian operations for the time being, and that means temporary layoffs. There has been more government responses now – BC premier John Horgan is setting up new meetings, while Carolyn Bennett is heading to BC to meet with those hereditary chiefs, while Marc Miller will be meeting with the Mohawk leaders setting up the blockades in Central Canada (while Justin Trudeau says he remains apprised of the situation while abroad, and will be returning to Ottawa tonight following the conclusion of the security conference in Munich). Trudeau reached out to one of the First Nations leaders leading a solidarity protest blockading the port in Prince Rupert, and that seems to have worked, as they agreed to dismantle that particular blockade.

Part of what is underlying the response to these protests seems to be an aversion to another Oka crisis – so we’ll see whether there have really been any lessons learned, thirty years later. And police action would inflame the situation, and they seem to be alive to that situation, which is probably a good thing. I have to wonder if part of the response to this isn’t also a bit of a mirror of what we saw recently with the CN Rail strike, where certain voices started immediately howling that Parliament needed to be summoned in order to ram through back-to-work legislation or there would be dire consequences, and the government held off and lo, a resolution came within about eight days. Was there some disruption? Yes. Was the outcome better than if they had taken out the sledgehammer? Undoubtedly. And it would seem to me that similar thinking is underway here. Despite a few middle aged, white male columnists are melting down over, things are not at a crisis level – they are largely inconveniences, which is the point of protest. And by not making things worse, there remains a chance to resolve this in a peaceable manner.

This having been said, the cries that Trudeau is off trying to secure a UN Security Council seat instead of dealing with this “crisis” are myopic and don’t grasp what the seat would do for Canada (articulated in this thread), though I will lay that on this government’s chronic inability to communicate their way out of a wet paper bag. I also suspect that the hereditary chiefs’ attempt to launch a constitutional challenge against the pipeline on an environmental basis is going to blow up in their faces, so I’m not sure either side is doing themselves any particular favours in all of this.

Roundup: Holding off on enforcement

Indigenous protests continue across the country in support of those protesting the Coastal GasLink pipeline, with not only rail disruptions, but also blockades around legislatures and city halls (Halifax city hall being a target that nearly kept Chrystia Freeland from the building). Thus far, police have not cleared any of them despite warnings that enforcing the various court orders will be imminent, and even some Indigenous leaders are calling on their people to end the blockades. That doesn’t seem to have persuaded any of them just yet. (The Star hears from protesters themselves here).

While Jagmeet Singh is calling on Justin Trudeau to return from his foreign trip early to deal with the situation, and Andrew Scheer hinting that he wants politicians to direct the RCMP to enforce those court orders right away (which is a very bad idea and has led to past flashpoints with Indigenous communities), Trudeau says he and his Cabinet are monitoring the situation but are content to let the provinces continue to handle those issues that are within their jurisdiction – as well he should. I suspect that one of the reasons why the RCMP and OPP are holding off on any enforcement actions just yet are because moving too soon will simply generate more sympathy for the protesters and possibly escalate the situation across the country, whereas waiting another day or two will lose those protesters any sympathy as the inconvenience becomes too much for most Canadians, and that most of the protesters will get bored and go home on their own before too long.

Meanwhile, Susan Delacourt remarks on the impossible situation that Justin Trudeau has been placed in by this situation, while Chris Selley wonders how we can be considered a grown-up country if we can allow the disruptions to continue without treating it like a serious situation that it is for many people affected by it. As well, here is an explainer from last year about the dispute within the Wet’suwet’en First Nation, and how that affects the duty to consult.

Teck Frontier mine

I wanted to point you to this piece, written by energy economist Andrew Leach and environmental law professor Martin Olszynski, which puts a lot more facts and context on the table regarding the Teck Frontier mine application and what is really being considered by Cabinet. In particular, because market conditions have changed so much since the project was first proposed in 2011, and the (flawed) economic impact analysis along with it, it means that the expected economic benefits are far, far less than what was initially promised (when they assumed oil at $95/barrel; it’s currently hovering around $50/barrel), and that will have to weigh in on the government’s decision. After all, the decision tends to boil down to how much economic benefit is worth the significant adverse environmental impact of the project – and it will be significant. And if the benefits are far below what they were initially sold to be, does that make it worthwhile to approve the project knowing that the benefits won’t necessarily outweigh the impact. It’s certainly worth thinking on – especially as the provincial government is now casting aspersions on the First Nation that is balking after the lack of ongoing engagement, and the rhetoric continues to heat up to outsized proportions.

Roundup: Open letters and complications

Alberta premier Jason Kenney took the next step in his performance art when it comes to demanding the approval of the Teck Frontier mine, and released an open letter to Justin Trudeau, which reiterated his points for the approval of the project. Of course, he didn’t actually tell the truth with all of those points, which is kind of awkward. (And hey, CBC, you could have done more than just retype Kenney’s letter and actually include some of the pushback, like Andrew Leach’s fact-checking).

Leach also has some problems with the lack of a viable reclamation plan for the project’s end-pit lakes, which is kind of a big deal, because it does seem like they’re trying to handwave away the problem, and hope that maybe in the future they’ll have a magic new technology that will solve the problem. That’s not a good thing. (Thread here).

Meanwhile, the federal decision on the Teck Frontier mine may be complicated as at least one affected First Nation says their concerns aren’t being addressed by the province, which is kind of a big deal. In fact, he said that the federal government has been doing their part, but the province under Kenney’s government has pretty much walked away after the previous government was doing the work with them – hence why they’re calling for the project to only be conditionally approved, with the condition being that the province be given a deadline to complete their talks with the First Nation and addressing their concerns about the impacts that the project (if it goes ahead, which it likely won’t anytime soon) would have on their local environment. It would seem to me that it’s a problem that Kenney keeps insisting they have full Indigenous sign-off on the project if in fact they actually don’t – but the truth hasn’t stopped him at any point thus far.

Roundup: Rushing a resurrected bill

The government made good on their promise yesterday to re-introduce Rona Ambrose’s bill on sexual assault training for judges, and to their credit, they tabled an amended bill that does take into account most of the criticisms of the previous version of the bill that likely would have rendered it unconstitutional because it interfered with judicial independence in pretty much every respect. (See my story here). Not that you’d know it from some of the reporting – the CBC in particular has been absolutely allergic in looking into what the objections to the bill were, and why they made it unworkable and unconstitutional, preferring to blame the Senate as being an “old boys’ club” rather than objecting to an unworkable and unconstitutional bill – you know, like they’re supposed to.

But despite every party supporting the bill, that didn’t stop them from getting cute with it. The Conservatives, for example, suggested in Question Period that the government amend the bill so that it also includes training for Parole Board members – which is out of step for the language in the bill. Because, seriously, the Canadian Judicial Council is not going to provide that training, as the bill stipulates that they do for judges. And then Jagmeet Singh decided he too was going to be cute, after QP, and move that the House vote to pass the bill at all stages in one fell swoop, with no scrutiny. The Conservatives blocked that (possibly to put on a show about their floated notion about Parole Board officers), but seriously, Singh was completely offside in moving the motion in the first place.

The previous version of the bill was fatally flawed, but it passed the House of Commons unanimously because it hadn’t been properly studied. They sent it to the Status of Women committee, which has no expertise in the legal system and how it operates, and they focused on survivor-based training, which actually turns out to be problematic because it could potentially bias the training, particularly when it comes to the presumption of innocence before the law. It wasn’t until the bill reached the Senate that its flaws were actually discussed, but hey, it sounded like a good idea so all MPs passed it without thinking. Let me be clear – that’s a terrible way to pass laws, and it’s MPs abandoning their roles. As a former criminal defence lawyer, you would think that Singh might appreciate the problems inherent in the bill, particularly when it comes to bias and judicial independence – the latter of which I challenged him on in a scrum after QP – and he was completely oblivious to it, mouthing platitudes about sexual assault survivors. That’s not how Parliament is supposed to work. It would be great if our opposition parties could do their jobs, but it increasingly feels like it’s too much to ask. (The same goes for you, CBC).

Roundup: When lower carbon is not lower carbon

As the various interests trying to promote the continued development of Alberta’s energy sector amidst changing global markets and the need to move to a carbon-constrained future, one is bound to find a number of arguments that are inherently self-serving and containing falsehoods (such as the fiction that Andrew Scheer and Jason Kenney keep trying to promote that somehow Alberta energy can reduce the environmental footprint in China and India, and that we can take their emissions credits for it). Energy economist Andrew Leach found another one promulgated by the Canadian Association of Petroleum Producers (which I will remind you is an organization that has gone so far to the one side that major players like Royal Dutch Shell have withdrawn from the group, because they understand the need for mechanisms like carbon pricing).

Roundup: Congeniality by way of TV

Maclean’s has a profile of the TVO series Political Blind Date, which pits politicians from rival parties – sometimes from the same level of government, sometimes from different provinces – in situations that help them understand each other’s viewpoints and helps to break down the partisanship barriers. And this is great – but what it was missing was any particular context as to why partisanship has grown to such toxic levels in the first place, and that has a lot to do with parliaments and legislatures rejigging their rules to be more “family friendly.”

Until the early 1990s, parliament used to hold evening sittings three nights a week. At six o’clock, the House would adjourn, and everyone would head upstairs to the Parliamentary Restaurant (aided by the fact that there was a dearth of restaurant options in the area, and liquor laws were such that you bought a bottle of booze that was kept behind the bar in the restaurant with your name on it). MPs would eat together, drink together, get to know one another across party lines, and it developed a sense of congeniality, and at eight o’clock, they’d head back to the Chamber and debate for a couple of more hours. The arrival of the Reform Party and the move to end evening sittings to be “family friendly” ended the congeniality and cross-party opportunities to just be parliamentarians together. With no impetus to break bread together, caucuses grew insular, and it became easier to treat other parties as the enemy rather than just having opposing points of view. Now, it’s rare that cross-party friendships occur unless there is committee travel that helps MPs bond, but that’s not very often. It’s disappointing that we are now relying on a TV show to build these relationships which used to be part and parcel of being an MP.

What’s particularly sad is that this kind of thing is now infecting the Senate, which used to be a far less partisan place than the House of Commons, and for which many senators have formed close and long-lasting friendships across the aisle. They still have more of the convivial culture that the Commons did, but that too is fading as the new Independents, eager to burn things down and declare anyone with partisan affiliation to be tainted and in some cases the enemy (particularly the Conservatives), it is polarizing the Chamber, and souring the mood therein. For a move that was supposed to lessen partisanship, Trudeau’s brilliant attempt to reform the Senate is doing the opposite – just one more unintended consequence that nobody bothered to consider, and all Canadians suffer as a result.

Roundup: Giddy or furious?

The potential move of Prince Harry and Meghan, Duchess of Sussex, to Canada is causing a great deal of media speculation, and a share of boneheaded headlines in international papers (the New York Times being particularly egregious in citing that Canadians are “giddy” – in the very week that we have been in mourning over the downing of Flight PS752 – that they could be adding some “razzle dazzle” to our “bone-chilling” country). And then there are all the polls demanding that Harry be made Governor General, or the speculation that we could make him Kind of Canada if we wanted (which we really don’t). Nevertheless, Philippe Lagassé had a few thoughts on the whole matter:

At the same time as we’re allegedly giddy, we’re also apparently “furious” about potential security costs. Which, could very well be, nothing at all, really. And in the coming week or two, I suspect these stories will be all the more absurd.
