Nearly all the desks were filled on what was possibly the final QP of the spring. Andrew Scheer led off, concerned about the “astronomical” debt the Liberals were leaving behind (which, in absolute terms, is one of the envies of the world because it’s quite low). Justin Trudeau reminded him that they won the election on promises to invest. Scheer tried again, giving a lame “budgets don’t balance themselves” quip, and Trudeau again reminded him that they needed to invest after the previous government didn’t and hey, lower taxes for the middle class and the Canada Child Benefit. Scheer railed about all of the new taxes being levied (most of which were not new taxes but cancelled tax credits that had little efficacy), and the PM reiterated that he lowered taxes. Scheer jabbed that Trudeau had never been part of the middle class, and Trudeau hit back that boutique tax credits and lower taxes on the wealthiest didn’t help those who needed it the most. Scheer then turned to the new national security bill, saying it removed needed tools for law enforcement agencies. Trudeau noted that they were balancing community safety with rights and freedoms, and that they welcomed recommendations for amendments. Thomas Mulcair was up next, grousing that the government broke their promise on allowing Access to Information requests to ministers offices and the PMO. Trudeau simply noted that they made the biggest reforms to the bills and increased proactive disclosure. Mulcair tried again with added mocking, but Trudeau didn’t budge, and Mulcair then railed that they kicked journalists out of a party fundraiser. Trudeau reminded him that they have raised the bar on transparency and that other parties weren’t doing. Mulcair tried again in French, but Trudeau’s answer didn’t change.

Roundup: Constituent consultation
In another instance of MPs breaking ranks, Conservative MP Scott Reid bucked the party by opting to vote to send the marijuana legalization bill to committee on second reading. Reid notes that he has favoured legalization since 2000, and it also didn’t escape anyone’s notice that his riding is home to a major medical marijuana factory which is also looking to scale up for the recreational market.
Of course, Reid is putting this with conditions, which is that he wants amendments to the bill at committee, which includes raising the legal age to 21 (because that will totally help kill the black market), and allowing communities to maintain their own prohibitions (again, good luck with the black market). More interestingly is the fact that Reid is promising a “constituency referendum” on whether or not he should vote for the bill at third reading.
It’s this referendum that I have questions about, but Reid points out in his statement that he has done this thrice before, so I’m not sure by what method he did (phone poll? Online voting?) and it’s more indicative of the Reform Party era where this sort of thing was promised a lot, and then rapidly fell into disuse because it’s not easy to organize, especially on a consistent basis with the volume of legislation that can pass through the Commons in any given session. Nevertheless, it’s novel and likely riddled with problems, and I’m not sure I would want to see MPs doing it on a regular basis because part of why we elect them in the way we do is for their judgment in a representative democracy. But…it’s novel.
Roundup: Freeland articulates her vision
Foreign Affairs minister Chrystia Freeland gave her major foreign policy speech yesterday in the House of Commons, and the theme was basically that we can’t rely on the Americans anymore, so it’s time to step up more, and that includes hard power. That also means more spending on the military, some of which is there and waiting to actually be spent once we get some of our procurement issues sorted, but that particular speech is later today as the Defence Policy Review is finally unveiled. (And incidentally, on Friday, Marie-Claude Bibeau will unveil our feminist foreign aid policy). It was noted by a couple of people, chiefly among them Paul Wells, that we really should have a major foreign policy speech every year or so, and this is certainly a better indication of where the government’s thinking is at.

This was not the case with the previous government, and it’s certainly worth noting. That this government actually uses the time allotted for statements by ministers is a good thing, as the constant eschewing of Parliament in favour of human backdrops in some alternate location was insulting.

Roundup: The difficulty with tracking spending
The Parliamentary Budget Officer’s latest analysis shows that it’s difficult to track budgetary spending commitments because they don’t often line up with the Supplementary Estimates. And yes, this is a problem. The solution is something that the government has already committed to, which is to reform the Estimates process. Right now, it is out of sync with the budget, where the Estimates need to be out before the beginning of the new fiscal year, but there is no set time for the budget to be released, meaning that the allocation of budget dollars happens before Parliament sees the budget. Later allocations to match the budget are supposed to then show up in the Supplementary Estimates, but as the PBO shows in his analysis, that’s hard to track. And even harder to track is whether those Estimates wound up being spent properly because the accounting systems used between the Estimates and the Public Accounts at the end of the fiscal year no longer match up, so tracking those dollars is also near-impossible. This has been an ongoing problem for decades, and the Liberals were elected on a promise to fix this problem. They have started to, but in recent months, the Treasury Board president, Scott Brison, says he has encountered resistance from the civil service when it comes to how they time things, and he’s trying to fix it. So that’s the hope, anyway.
What I hope comes from this exercise, however, is increased pressure on Brison and the government to carry on with reforming the Estimates cycle so that it better matches the budget cycle, and that the Estimates match the Public Accounts at the end of the year so that money can actually be tracked. What I hope doesn’t happen is for this to turn into calls to turn over yet more power and authority for scrutinizing the estimates to the PBO because that’s the whole raison d’etre of MPs, and they should be demanding that it be in a format that they can use and understand.

Roundup: An unconstitutional motion
As stated for their upcoming Supply Day motion (currently scheduled for Monday, the Conservatives have drafted a resolution that would see the House of Commons express non-confidence in Minister Sajjan and Minister Sajjan alone. It’s the kind of thing that makes me want to bash my head into a wall before my head explodes because it’s so very boneheaded from start to finish.
First of all, you should read this post by James Bowden, who takes apart the motion to and shows that it is unconstitutional. What is more interesting is the fact that the NDP tried this tactic before when Rona Ambrose was minister of the environment, and the Speaker ruled it out of order then, just as Speaker Regan should this time. Why? Because one of the fundamental tenets of Responsible Government is that of Cabinet solidarity. Cabinet lives and dies as a single body – there is no dispensation given to ministers we like, or to simply cull the prime minister from the rest of them in these kinds of votes. It’s an important feature of why the system works the way it does, and trying to cherry pick it for the sake of political tactics makes one a bit queasy because this is our very system of government that we’re talking about and they should bloody well know better.
Look, I get that they’re trying to exploit what they see as low-hanging fruit with Sajjan, but along the way, they’ve been dangerously blurring the lines of civil-military relations by asserting that the troops want him gone (do they aside from a few cranks? Never mind that it’s not these soldiers’ call), and by referencing Sajjan’s actions in military terms rather than political ones. Trying to use the term “stolen valour” is also offensive, not only because it’s generally reserved for someone who dons a uniform or medals without having been in combat (which is not the case with Sajjan), but because they’re co-opting it from the military for political benefit. But now they’re trying to go against the fundamentals of Responsible Government to score what they hope will be a cheap win.
That Her Majesty’s Loyal Opposition is trying to burn the system to the ground to score a couple of points is a very serious problem, and one indicative of a party that is more focused on populist spin than they are in being principled. It’s a disturbing pattern, and one that they should knock off before they go too far down this garden path.

Ambrose railed that Sajjan behaved like a politician — because that’s what he is — but Sajjan stuck to assurances that he was looking after the troops. Ambrose turned to tax benefits for those serving in Kuwait, and Sajjan said that they would ensure that they would have the necessary benefits owed to them and they were ensuring fair compensation rules were in place. Ambrose accused him of misleading the House on the issue, and Sajjan spoke about fixing the immediate problem, and there was a difference between tax-free benefits and hardship allowance. Ambrose then turned to defence funding, and demanded Sajjan’s resignation. Sajjan said they were putting the Canadian Forces onto a sustainable footing. Ambrose cherry-picked past defence spending of the previous government (ignoring that many of those procurements, like the helicopters, were badly bungled), and Sajjan expounded upon the non-partisan advice they got on the defence file and that they were moving ahead to recapitalise the Forces.

That was Alexandre Boulerice who railed about finalising rules, and Karina Gould assured him they were tabling rules for more transparency. Boulerice then railed about handcuffing the PBO, and Bardish Chagger said they were making him more independent but were open to amendments. Cullen was back up to ask the same in English, and Chagger repeated her answer.

Roundup: Wise asses and the Wise Owls
The snickering and childish guffaws that accompanied the news that the Senate released a children’s book-style brochure about the Senate was predictable. Every single wise ass in the pundit sphere threw in their two cents, many of them in the tiresome form of children’s book verses of their own, detailing how sordid those awful owls really are, and aren’t we clever for subverting this book? Others decried the (meagre) expenses and time used to create such a brochure, never mind that these very same pundits kept wondering aloud why the Senate never promotes itself or its good works. And while a more grown-up brochure was also produced alongside it, nary a soul mentioned that one.

I will be the first to say that The Wise Owls is not without its flaws, particularly in how they allegorically depict how and why the Senate came about. It was not because the House of Commons wasn’t working, and it’s particularly disingenuous to suggest that was the case. The general audience brochure has a more accurate take on that history, but I will also add that one of the problems with that brochure is that it places the legislative role of the Senate above all others under the heading that “Senators are lawmakers.” The abuse of the term “lawmakers” in the Canadian context rankles me because it’s an Americanism owing to how their system works, while our parliamentarians in our system are about holding the government to account, and legislating they do is a by-product of that as opposed to their raison d’être.
Nevertheless, some of the reactions to the book have also been particularly problematic, from Elizabeth May complaining that it’s not good democratic education because it implies that those responsible for sober second thought are wiser than those who are elected, to journalists like Justin Ling, who complain that the message to children is that your elected officials can’t be trusted.

Putting aside the potential that this is petty jealousy – after all, it would seem to be the media’s job to keep telling people that our elected officials are not to be trusted – these complaints ignore the fact that the entire Westminster system is predicated on that very fact – that while it’s all well and good to have elected officials, we still need safeguards against the excesses of populism. It’s why we have a monarch who is a disinterested party that can hit the reset button in times of crisis. It’s why we have an upper chamber that is appointed and not pandering for votes and has the institutional independence to speak truth to power. It’s why our courts don’t rely on judges to tailor their verdicts with an eye toward keeping the public favour in order to seek re-election. The very foundation of our system is that sometimes elected officials need to be reined in, and not by yet more elected officials. It shouldn’t be scandalous that this very same message is what this book exposes children to.
Roundup: Troubling rumblings in civil-military relations
There is much wailing and gnashing of teeth about comments that Harjit Sajjan made in India that he was the architect of Operation Medusa in Afghanistan, before he later retracted and said that he was part of the team led by General Fraser. Part of why this has been mystifying for many is the fact that the error was made in his prepared remarks, which should have been caught but wasn’t, and now there are accusations of glory-seeking and trying to claim credit, which seems out of character for someone who seemed to rebuff the label of being “badass” when he was first appointed minister. I would say that the days it took for him to issue a proper apology are also mystifying, but this is politics, and nobody likes to admit error and there is likely a reflexive instinct there that needs to be dragged out. Because politics gonna politics, unfortunately.
What is more disturbing in this is the fact that you have both active and former military personnel calling for Sajjan’s resignation, which is a pretty big breach of civil-military relations. What I find even more disturbing is the fact that if you add this to the allegations that VADM Mark Norman was trying to make political decisions and using leaks to pressure the government to adopting his position on that procurement contract is that there may be a growing breach of the civil-military relationship in this country, and that is a Very Bad Thing.

Roundup: Leaking cabinet confidences is a Big Deal
I will readily admit that I haven’t been keeping as close of an eye on the whole drama surrounding the suspension of Vice-Admiral Mark Norman from the post of vice-chief of defence staff, and the alleged leaks surrounding the contract to refit a supply ship for our navy (which currently has none, thanks to consistently bungled procurement processes). It wasn’t until this particular walkthrough from Murray Brewster that the elements of the story all started to crystalize, in part because we finally got some more details about just what was being alleged thanks to a judge ordering the release of information. Over the past couple of days, the extent of those backchannel conversations with certain shipyards and their aim – to use media leaks to publicly pressure the government to go a certain route when they were resistant – may seem like pretty insider stuff, but it actually has some pretty broad implications for our entire Westminster-system of government.
While you may have certain pundits who bemoan the case against Norman is thin gruel, especially in light of the whole lack of convictions in the ClusterDuff affair, I have to say that leaking cabinet confidences is probably a little more significant. As noted parliamentary scholar Donald Savoie notes in this piece, Cabinet secrecy underpins our entire system of government because it relies on government to act with one voice, and to stand and fall in unison rather than with ministers as individuals. Cabinet solidarity is a Thing, and it’s an important Thing. Cabinet secrecy ensures that there can be a full airing of views and that it’s not just a focus group for the prime minister, and this extends to the advice that the civil service is able to provide. There needs to be a certain amount of secrecy to that advice so that there can be a meaningful back-and-forth of ideas and discussion before a political decision can be taken, and then held to account.
What Norman allegedly did was to use his position as a servant of the Crown, who swore an oath to the Queen and not the government of the day, to further his own interests. He was taking the political decision, and allegedly leaking those cabinet confidences in order to force the situation toward his desired outcome. That not only violates the roles of the civil service (and military by extension), but it undermines cabinet government. We The Media may grouse about the extent to which things are declared cabinet confidence, but it is important – particularly because this government is practicing cabinet government more than its predecessors have been, or even many of the provinces. I’ve had conversations with current ministerial staff here who used to work at Queen’s Park who have attested that cabinet government is real here, unlike Ontario, where it was all controlled from the centre. Leaking confidences undermines this, and it is a serious matter – not just the thin gruel that some would have us believe.
QP: Women ask the questions
It being International Women’s Day, one expected that all questions posed would be by women MPs. Rona Ambrose led off, trolling for support for her bill on training judges in sexual assault law (which, incidentally, I wrote about for this week’s Law Times, and the legal community was pretty clear that they felt this wasn’t the right way to go and this bill could impact on judicial independence). Justin Trudeau spoke about the importance of supporting survivors of sexual assault, but would not commit to supporting it. After another round of the same, Ambrose wanted support for Wynn’s Law on bail applications, to which Trudeau said that the justice minister spoke to Constable Wynn’s window but would not commit to supporting it. Ambrose asked about a bill on human trafficking and why it eliminated back-to-back sentencing provisions, but Trudeau responded in his condemnation of those crimes but not in backing down on the provisions in the bill given their commitment to the Charter. Ambrose asked about helping women come forward to report sexual assault, and Trudeau noted that this was a concern and they have a ways to go. Shiela Malcolmson led off, heralding Iceland’s work on pay equity legislation, to which Trudeau said they were working on legislation. Brigitte Sansoucy asked another pay equity question in French, and got much the same answer. Sansoucy moved onto tax evasion and demands to end amnesty deals, and Trudeau noted that they were working on ending tax evasion by investing in the CRA’s capacity to do so. Tracey Ramsey asked the same again in English, and got the same answer.
