Roundup: The flailing incompetence of Ontario’s new sick days

If there was any doubt that the murderclowns in Doug Ford’s government were flailing incoherently, they announced a new paid sick leave programme yesterday, and wouldn’t you know it, it defies all common sense or logic. The idea is that employees get up to three days of paid sick leave – temporarily, because heaven forbid they stand up to the small business lobby and make this permanent – and employers can claim up to $200 per day for those employees, but they have to do it through the Workers Compensation bureaucracy, for some unknown reason. And we still have no idea what kinds of protections are actually in place for the workers if they use those days, because that’s a very big part of this. Furthermore, this was the province doing the bare minimum – they chose three days apparently because a) it’s what is currently in the Canada Labour Code for federally-regulated workers, and b) after three days, a person could claim the federal sickness benefit (because it pays out for the week), so they’re still trying to fob people off on to a system that was designed for those who can’t access employer-paid sick leave because they don’t have a traditional employer. And possibly the most galling part was how much the provincial labour minister was patting himself on the back for these woefully inadequate half-measures (which people were having to say was a “great first start” through gritted teeth all evening).

It shouldn’t have been like this. The easy fix was to simply allow sufficient days (probably up to ten given the current circumstances) under the provincial labour code, and employers could then access rebates either through the federal wage subsidy, as it’s been designed for, or a provincial stop-gap if they’re not currently on said subsidy, and it would have been easier, it would have protected jobs and workers’ rights, it would have been seamless, and we wouldn’t have the same problems that we’re having right now with those trying to access the federal benefit (which was not designed for these circumstances). But that would have angered the business lobbies, and Doug Ford would never want to do that, because they’re whom he considers the “little guy” that he looks out for. So here we are instead, with another badly designed system that seeks to do the bare minimum, and because this was done in haste, and with this government’s usual flailing incompetence, I suspect we won’t be out of problems with it anytime soon – just like everything else that has gone to wrong in this province, because it’s being run by incompetent murderclowns.

In case you were wondering what all of this flailing was trying to cover, it would be the Auditor General’s report on long-term care, which was a not unexpected recounting that there was a woeful lack of preparation, where long-standing problems quickly got amplified, while the ministry of long-term care was not prepared or equipped to deal with those issues. Again, not a surprise, but damning nevertheless. And what did the minister responsible for long-term care do? Blame everyone else including the NDP – who haven’t been in power since 1995 – for “starting the fire,” and she insisted that she was the one who ran into the burning building to save people, which…is a novel interpretation, especially considering that her government reduced the number of inspections and made things worse. Of course, we are in a system of Responsible Government, and she is the minister in charge of the portfolio, and guess what – she is responsible. If she had any modicum of shame or decency, she would tender her resignation for allowing the deaths of thousands on her hands, but this band of murderclowns are absolutely incapable of decency or shame.

Roundup: Ford’s sick days deception

The issue of paid sick days went completely sideways in Ontario after the murderclown government, thinking they were clever, tried to propose that the federal government simply double the payout of the federal sickness benefit programme, promising that they would cover the difference, and leave it at that. Not surprisingly, the federal government said no, because the federal sickness benefit is not paid sick leave, and everybody knows it. Doug Ford knows that, because he repealed the paid sick days that were legislated in the province, at the behest of business owners (because when Ford says he’s looking out for “the little guy,” he means the business owner). Reinstating them is a simple fix in the province’s labour code, unlike “fixing” the federal benefit, which is an impossibility because a) it’s not their jurisdiction, and b) they are limited by their back-end IT infrastructure, which in no way could allow them to have seamless paid sick days the way amending the provincial labour codes would allow. (The federal government could do more when it comes to the sick leave provisions in federally-regulated workplaces, but they are not starting from zero like provinces are).

While on Power & Politics, Ontario’s labour minister, Monty McNaughton, did let slip that they didn’t want to implement actual paid sick days because it would be a burden on businesses, which were already suffering from the pandemic – as though having an outbreak in their facility won’t hurt them even more, or having their employees die of COVID. That, and they have options available to them, such as using the wage subsidy to pay for their employees’ sick leave – that’s one of the reasons it’s there. The whole gods damned point of the federal sickness benefit is for those who don’t have employers, like the self-employed, who could need some kind of income support if they can’t work because of COVID. It was never supposed to replace actual paid sick leave, but premiers decided that they could try to get around their own obligations with it.

Meanwhile, BC premier John Horgan is putting on a song and dance of reluctantly implementing paid sick leave in BC – fourteen months later – and making a theatrical production of trying to claim they wanted to make this a national programme. This, dear readers, is horseshit. Labour codes are provincial jurisdiction in 94 percent of workplaces, and if the federal government had tried to come up with a national paid sick leave programme pre-pandemic, every single premier would have cried jurisdiction and refused on principle. For Horgan and other premiers to now try and claim they want a federal programme is a lie, and an attempt at giving themselves cover. They are trying to avoid the wrath of the business lobbies, and the small business lobby in particular, and trying to use a federal programme designed primarily for the self-employed as their fig leaf.

Even more to the point, I cannot abide how pretty much every single media outlet has framed this issue, painting it as either federal-provincial “finger-pointing,” or even worse, claiming that Ford’s proposal as being some kind of “compromise.” It is not a compromise – it’s more deception that these media outlets are spooning up. And they keep offering Doug Ford political cover. I cannot stress this enough. By trying to be “neutral” and both-sidesing the issue, they are providing Ford with more ability to try and pin this on the federal government when it’s his issue, in his jurisdiction, and he needs to own it.

Roundup: Some pushback on the hybrid sittings

I felt a tiny glimmer of hope over the weekend as I read this piece that talked to three MPs from each of the main parties about their experience with hybrid sittings, and lo, MPs are unimpressed. Praise be! Mind you, it’s a small sample, and it’s all Manitoba MPs (given that it was a piece in the Winnipeg Free Press), but props for having this conversation with them, and props for not letting it simply go by unquestioned, as is often the case.

This being said, I don’t think we’re out of the woods yet in terms of what the lasting implications of these hybrid changes will be, particularly when there are west coast MPs who are loudly praising the hybrid format, and when groups like Samara Canada are already lining up the excuses to allow it to keep happening, which is exactly the kind of slippery slope that I have been warning about since before this began. Don’t forget that the Liberals were pushing for these kinds of changes for nearly five years before the pandemic hit, and this was the perfect excuse for them to finally implement them, even if it was under the rubric of it being for the duration of the emergency. But as you’ve heard me warn before, they will soon find a list of excuses – just as Samara provided for them – to keep them going in some capacity, which will have a long-term erosion on our system and the norms therein. I am especially worried that there will be pressure to keep the voting app system going, even though, as the interviews in the article pointed out, this system greatly benefits the government because it doesn’t allow opposition MPs to use the votes to register displeasure (such as slow-voting). So while it’s great that some MPs want a return to proper sittings (one of them being an advocate for a parliamentary bubble, to little avail), there is still going to be a fight to ensure these changes stay are relegated to the dust heap once the pandemic is over.

QP: Questions from a fantasyland awash in vaccines

For the first post-budget Porto-PMQs, Justin Trudeau was present and ready to go, with only Mark Gerretsen in the Chamber with him on the Liberal benches – of course. Erin O’Toole led off, script on mini-lectern, and complained that the vaccine rollout was only running at 58 percent capacity due to supply issues, and Trudeau listed the coming millions of doses being delivered by May. O’Toole groused about the “race” against variants, and demanded border closures from hot spot countries, not naming any countries in particular, for which Trudeau stated that we already have some of the strongest border measures in the world, but they would look at other ways to keep Canadian safe based on science and data, but importation was a fraction of cases. O’Toole then accused the government of “stealing vaccines” from the developing world, and Trudeau pointed out that this was disinformation and that O’Toole did not ask about the budget, which must mean he supports it. O’Toole switched to French, and he demanded increased health transfers to the provinces, and Trudeau pointed out that there must be a reason why the Conservative leader only asks about the budget in French, before reciting how much they have sent to provinces. For his final question, O’Toole claimed that the US changed their travel advisory on Canada, and Trudeau pointed out that in all five questions, he peddled falsehoods to score political points.

Yves-François Blanchet was up for the Bloc, and he decried that the were no increased health transfers in the budget, and Trudeau reminded him that they had a meeting with premiers in November that they said that they would increase transfers once they were out of the pandemic, and pointed to the supports they are already delivering. Blanchet stated that they were going against the wishes of the Quebec government and then mentioned their demand for enriched pensions for all seniors, for which Trudeau reminded that they have been delivering for seniors.

Jagmeet Singh led for the NDP, and unusually started off in English to demand the government invoke the Emergencies Act, and Trudeau reminded him that they have been delivering for provinces. Singh read another sob story from someone who lost a family member for COVID, and demanded improved access to paid sick leave — which is provincial jurisdiction in 94 percent of workplaces. Trudeau noted their federal benefit, and said they would continue to have people’s backs.

Roundup: Flexibility and red lines on child care negotiations

A day out from the federal budget, we are getting some reaction to the centrepiece proposal of a massive expansion to early learning and child care, particularly from provinces with whom this all needs to be negotiated. It sounds like several of them are welcoming the new funding, and Chrystia Freeland has signalled some willingness for flexibility, but is drawing a red line around keeping fees low, because the whole point of this is to reduce barriers to women getting in the workforce, and high fees are very much a barrier, even when there are available spaces (which is often not the case). And yes, there are already recalcitrant provinces, looking particularly to Alberta and Ontario, and some of their objections are grounded in the fantasyland that there is no such thing as constrained choice. Of course.

For some more context, here is a good interview with Don Giesbrecht, CEO of the Canadian Child Care Federation, which gives a good lay of the land of the current system of bilateral agreements that the federal government has in place with provinces around childcare funding, and yes, there are strings attached to that funding. This new funding will build on those agreements, which is why it’s not entirely out of the blue and building something from the ground-up, but simply taking things up an order of magnitude from where they exist currently.

Meanwhile, my social media has been flooded with salty New Democrats who think that they’ve somehow caught me out in previously pointing out that this is an area of provincial jurisdiction whenever Jagmeet Singh would performatively demand “concrete action” on childcare or the like. For starters, at no time did I declare this Liberal plan a done deal – it has always been presented as being contingent upon negotiation with the provinces, but this time they’ve put money on the table that the provinces will find hard to refuse, especially because we have all seen the effect that this pandemic has had on women in the workforce. That’s a fairly unique set of circumstance that creates a hell of a lot more political pressure than could be applied previously. More to the point, Singh’s rhetoric, and those of his MPs, is largely grounded in Green Lantern Theory, that it’s simply a matter of willpower to overcome jurisdictional interviews, while they will only admit the need for negotiation in written releases or backgrounders and never out loud. This especially goes with making promises that they will “get it done,” as though they can put on their Green Lantern rings and just willpower it to happen, or drafting a federal bill and expecting the provinces to clamour to the sound of free money rather than doing the hard work of negotiation. Real life doesn’t work like that, which is what I have consistently pointed out. If New Democrats can’t understand that criticism, then I can’t help them.

Roundup: Freeland’s first big budget

The budget was released yesterday, and lo, the commitment to child care was huge – $30 billion over five years in order to build a national system of $10/day early learning and child care, which is huge money – money that will make it very, very hard for provinces to refuse. It’s not going to be immediate, but a process to build to that system, which they have already put work into over the past five years, but it’s a much more robust commitment than we have seen in the past. It means more negotiations with provinces, however, as well as an asymmetrical agreement with Quebec so that they can still get funding to augment their existing subsidised child care system.

While there is a good overview here, other items in the budget include:

  • Some $17.6 billion in new spending for GHG reductions.
  • New taxes on foreign investors in housing, with more commitments to the national housing strategy.
  • $18 billion over five years has been earmarked for Indigenous communities to close the socio-economic gaps.
  • There is a commitment for $400 million to combat sexual misconduct in the military, plus funds to revitalise NORAD and to cover our NATO operations
  • They plan to make it easier and cheaper to obtain a criminal pardon.
  • There will be new taxes on big global tech companies.
  • Here are twenty new or expanded benefits and taxes.
  • There is the usual pearl-clutching that the budget predicts some $686 billion in accumulated deficits over the next five years.
  • Here are ten smaller items in the budget that are of interest.

Something that did come up over the talking heads discussing the budget was pharmacare, and how there wasn’t a big song and dance about it, as that was largely reserved for childcare. I did read the section on pharacare in the document, and it notes continued investment in things like the catastrophic drug plan to help those who need it most, but we have to remember that they have been trying to negotiate this with the provinces, and the provinces have said no. There’s only so much the federal government can push them on this, so it may require waiting until a few provincial governments change hands before more progress can be made. That’s the thing about these kinds of programmes in provincial jurisdiction – you need to have willing partners at the table, or it can’t go anywhere.

Meanwhile, Heather Scoffield grouses that there is too much conventional thinking in the budget to deal with the problems exacerbated by the pandemic. Susan Delacourt looks to all of the promises that rely on federal-provincial negotiations to make them happen. Paul Wells offers a fairly sober assessment of what’s in the budget, and whether the enthusiasm for this child care spending will last the next couple of years.

Roundup: Federal damage control while Ford playacts

While Ontario continues to be on fire, Doug Ford spent much of the weekend walking back his ridiculous pronouncements on Friday, re-opening parks and playgrounds, followed by walking back the increased police powers (which was not helped by the fact that most police forces declared publicly that they would not use them – though stories of arbitrary accosting of people of colour did resonate over social media. This was then followed by news that Ford plans to shutter the legislature this week – apparently it’s the one workplace he doesn’t consider “essential” – while there is also talk about a Cabinet shuffle, because gods know this band of murderclowns needs to rearrange the deckchairs on their own personal Titanic one more time. (Speculation here is also that he is facing a very restive caucus, and closing Queen’s Park would make it easier to avoid them). And then, to make it look like he was doing something, Ford engaged in some performance art to phone up consulates and try to secure vaccines from international allies, as though they wouldn’t all laugh in his face. But he’s committed to the narrative that all he needs is more doses to vaccinate his way out of the burning building rather than doing the public health measures he needs to in order to stop the spread of the virus.

Meanwhile, prime minister Justin Trudeau announced some additional help for Ontario, some of which will wind up bypassing the provincial government and go directly to municipalities and businesses with things like additional testing and tracing capacity. Even these measures, however, are little more than damage control because they can’t do the things that need to happen, like stopping the spread in industrial workplaces, because they don’t have the requisite jurisdictional authority.

As for the doctors in this province, they’re at a breaking point. Thank the murderclowns for that.

Roundup: A broken system thwarting foreign agents

Something in the National Security and Intelligence Committee of Parliamentarians (NSICOP) annual report, made public this week caught my eye, which talked about how the “critical election incident protocol panel” – the body set up in order to have some sort of way to help deal with any detected foreign interference during an election (given the whole Russian interference thing south of the border in previous of their elections) – needs to include more traditional espionage as part of their warning triggers. Why? Because, as NSICOP says, foreign agents could try to infiltrate political parties to exert influence, whether it’s in nomination meetings, or volunteering in campaign offices.

I will admit that I laughed.

Not because foreign interference isn’t serious – because it is – but because the joke would be on them, given that grassroots members no longer have any influence in our political system since we have made the system entirely leader-driven. Nomination meetings are being gamed by leaders’ offices to the point where it’s difficult to determine just how free and fair any of them are these days – that is, when leaders aren’t outright appointing candidates (as Justin Trudeau did with Marci Ien and Ya’ara Saks for the by-elections late last year). Trying to hijack nomination contests at the best of times is exceedingly difficult because of the requirement for the leader’s signature (or their proxies, thanks to the garbage Reform Act), which was part of why that requirement was created back in 1970 – officially to keep the Chief Electoral Officer from needing to adjudicate nomination disputes, but anecdotally about heading off pro-life groups trying to hijack Liberal nominations. Foreign agents trying to use the same tactics would have fairly marginal chances of success once their involvement became known.

This is less of an indictment of the use of party infiltration as a tactic of foreign agents, but rather of how our system has degenerated. Because we insisted on moving to leadership contests that became quasi-presidential primaries, we have upended the entire grassroots nature of our parties, and now everything is top-down, leader driven. It shouldn’t be this way, and yet this is where we are.

Roundup: Contrasting convention speeches

The Liberal and NDP conventions went ahead “virtually” over the weekend, and from the sounds of it, the Liberals’ went smoothly, while the NDP’s was derided as glitchy, and delegates complained there was little opportunity for actual debate. For his convention speech, Justin Trudeau went hard at Erin O’Toole – befitting the partisan nature of the event – calling the Conservatives “disconnected,” going after their use of disinformation to score points, and pointing out that they would not have been willing to use government resources to help people get through the pandemic through mechanisms like CERB. He also encouraged people to reach out to neighbours, and tell them the Good Word of their lord and saviour Justin Trudeau about the plan the Liberals are building. As for policy resolutions, the party voted for several propositions around Basic Income, but also rejected policy planks to raise certain taxes, so that says a lot about where the party is at in their thought process.

For the NDP, after their policy resolutions (including $20 federal minimum wage) were dealt with – with much grumbling from the membership – Jagmeet Singh gave his speech, wherein he claimed that the only reason that the Liberals helped people in the pandemic was because the NDP forced them to (which would only be believable if you paid no attention at all to the Liberals’ willingness to spend any amount of money), and then made a bunch of false claims about pharmacare, and imported some American Democrat talking points about the ultra-wealthy. So, pretty standard for Singh.

Meanwhile, Chantal Hébert tries to tamp down some of the leadership speculation around Mark Carney by pointing out some realities of what that contest could look like. Susan Delacourt noticed that Justin Trudeau’s speech at their convention was much more embracing of Liberal history than he has been in the past. Delacourt also tried to divine what kinds of electoral priorities were to come out of the convention speeches by the two leaders. Paul Wells remarks on the lack of discussion about actual choices at the Liberal convention – which is a very important point, because parliamentary time is finite, as are money and resources, and if everything is a priority, then nothing is a priority, and it seems to be the case that Liberals are not getting that message.

Roundup: Waiting for the modelling to show up

If you weren’t convinced up until now that Ontario is being run by a group of incompetent murderclowns, there was a tacit admission yesterday from Solicitor General Sylvia Jones that the government held off on increasing restrictions because they wanted to see the modelling show up in hospitals first.

Let that sink in. Fourteen gods damned months into this pandemic, they still don’t understand that the modelling is a warning, not a prediction. They decided to wait until the lagging indicators – hospitalisation – was prevalent before “locking down” (but not really), which means that by this point, the spread of the virus is out of control. How they could not understand this fourteen gods damned months later is a sign that they are either wilfully ignorant, or they just don’t care. They were content to let people die because they couldn’t be arsed to stop the spread of the infection that they knew was coming for some wrong-headed notion about trying to “balance” the economy rather than ensuring people wouldn’t die – never mind that the economy would come back faster if they squashed the spread of the virus and it we wouldn’t any more lockdowns.

I’m still mad about this. I was mad about it all day since the interview hit social media. I would say it’s unbelievable, but given this particular posse of murderclowns and everything they’ve done in this pandemic, it’s unfortunately all too believable.
